CaseChat Overview and Summary
The Commission examined the process through which the agreement was negotiated and whether it complied with the procedural fairness requirements. The analysis involved scrutinizing the conduct of both the employer and the employee representatives during the negotiation process. The Commission also assessed the content of the agreement, ensuring it complied with the Fair Work Act's provisions regarding minimum entitlements and did not include any terms that would undermine the protections afforded by the Act.
The Fair Work Commission concluded that the agreement was made in good faith and without coercion, harassment, or undue influence. The Commission found that the negotiation process was procedurally fair and that the agreement provided for the proper operation of the business. The terms of the agreement were also deemed to be consistent with the Fair Work Act, providing employees with protections and entitlements not less favourable than those provided by the relevant industrial instrument. Consequently, the Commission approved the Asset Interiors Pty Ltd Enterprise Agreement 2014, allowing it to come into effect as per its terms.
