Citation

1. These regulations may be cited as the Assessment of Tertiary Institutions (Overseas

Students) Fees Regulations, 1990.

Interpretation

2. In these regulations—

"academic award" means an academic award within the meaning of the Act:

"the Act" means the Tertiary Education Act, 1986:

"course" means a course of tertiary education consisting of—

(a)

a series of subjects or units;

(b)

a project;

(c)

research work;

or

(d)

a combination of two or more of the above,

whether leading to an academic award or not:

"institution of tertiary education" means an institution of tertiary education within the

meaning of the Act:

"Minister" means the Minister of Employment and Further Education:

"principal institution" means a principal institution of tertiary education within the meaning

of the Act:

"registration" means—

(a)

in relation to an institution of tertiary education, the inclusion of the institution on a register of institutions endorsed by the Minister as suitable to provide courses to overseas students;

(b)

in relation to a course, the inclusion of the course on a register of courses endorsed by the Minister as suitable to be provided to overseas students.

Fees payable for the registration of an institution

3. The following fees are payable on application to the Office of Tertiary Education by an

institution of tertiary education for the registration, or renewal of registration, of the institution:

principal institutions:

(i)

registration, or renewal of

Fees payable for the registration of a course

4. The following fees are payable on application to the Office of Tertiary Education by an institution of tertiary education, other than a principal institution, for the registration, or renewal of registration, of a course or group of courses on the same or similar subject matter, for three years:

Additional fees

5. Where, in assessing an application for registration or renewal of registration of an institution of tertiary education or a course, the Office of Tertiary Education believes it is necessary to obtain the expertise of persons other than employees of the Office, whether those persons are from within or outside the State, all expenses reasonably incurred in doing so (including sitting fees and travel expenses) are payable by the institution of tertiary education in addition to the fees payable under regulations 3 and 4.

Fees on application not refundable

6. An amount paid under these regulations on application for registration or renewal of

registration is not refundable.
