Arts Acts (Amendment) Act 1998†

[Assented to 27 October 1998]

The Parliament of Victoria enacts as follows:

1. Purpose

The main purpose of this Act is to make
miscellaneous amendments to the Libraries Act
1988 and the National Gallery of Victoria Act

1966.

2. Commencement

(1) This Act, except section 3, comes into operation
on the day on which it receives the Royal Assent.

(2) Section 3 is deemed to have come into operation

on 26 May 1998.

3. Repeal of amendment to Libraries Act 1988

In Schedule 1 to the Public Sector Reform	No. 46/1998.
(Miscellaneous Amendments) Act 1998, under the heading Libraries Act 1988, the provision relating to section 29(1) of the Libraries Act 1988 is repealed.

4. Libraries Act 1988

In section 53 of the Libraries Act 1988, for sub-	No. 80/1988. Reprint No. 3
sections (3) and (4) substitute—	as at 26 March 1998.
"(3) The regulations are subject to disallowance	Further

by a House of the Parliament.".	amended by
Nos 5/1998
and 46/1998.

5. National Gallery of Victoria Act 1966

(1) In section 6(1) of the National Gallery of	No. 7482. Reprint No. 3
Victoria Act 1966—	as at 26 March 1998.

(a) for "nine members" substitute	Further
"11 members";	amended by
No. 5/1998.

(b) in paragraph (e), for "five" substitute "7".

(2) For section 6(3) of the National Gallery of

Victoria Act 1966 substitute—
"(3) The Public Sector Management and

Employment Act 1998 does not apply to a member of the Council in respect of the office of member.".

6. New section 25 inserted in National Gallery of Victoria Act 1966

After section 24 of the National Gallery of
Victoria Act 1966 insert—
"25. Saving for reconstituted Council

Despite the reconstitution of the Council effected by section 5(1) of the Arts Acts (Amendment) Act 1998, the Council is

deemed to be the same body after as before

the commencement of that provision.".
