Application for relief from unfair dismissal - application dismissed under s.587.
[1] This application was listed before the Fair Work Commission for arbitration on 5 and 6 December 2013. Prior to arbitration commencing the parties reached a settlement and entered into a deed of release.
[2] The applicant has not filed a notice of discontinuance.
[3] Since the matter was settled numerous attempts to contact the applicant regarding the notice of discontinuance have failed. No contact has been able to be made with the applicant.
[4] Pursuant to s.587 of the Fair Work Act 2009 I formally dismiss the application in this matter on the basis of the settlement reached between the parties.
