Army and Air Force Canteen Service Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Defence Act 1903.

1.   Commencement

1.1   These Regulations commence on 1 January 1998.

2.   Amendment

2.1   The Army and Air Force Canteen Service Regulations are amended as set out in these Regulations.

3.   Regulation 3 (Interpretation)

3.1   Subregulation 3 (1) (definition of “auditor”):

Omit the definition.

3.2   Subregulation 3 (2):

Omit the subregulation.

[NOTE:  As to the financial year of the Board that commenced on 31 January 1997, see the Audit (Transitional and Miscellaneous) Regulations.]

4.   Regulation 9 (Board of Management)

[NOTE:  The following note should be inserted after subregulation 9 (1):

“[NOTE:  The Commonwealth Authorities and Companies Act 1997 applies to the Board. That Act deals with matters relating to Commonwealth authorities, including reporting and accountability, banking and investment, and conduct of officers.]”.]

5.   Regulation 10 (Constitution of Board)

5.1   Paragraph 10 (6) (c):

Omit “his obligations under regulation 11,”, substitute “his or her obligations under section 21 of the Commonwealth Authorities and Companies Act 1997;”.

6.   Regulation 11 (Disclosure of interest by member, &c.)

6.1   Omit the regulation.

7.   Regulation 13 (General powers, duties and functions of the Board)

7.1   Paragraph 13 (1) (i):

Omit the paragraph.

8.   Regulation 23 (Bank account)

8.1   Omit the regulation.

9.   Regulation 23A (Application of money)

9.1   Subregulation 23A (1):

Omit “Subject to subregulation (2), the moneys”, substitute “The money”.

9.2   Subregulations 23A (2) and (3):

Omit the subregulations.

10.   Regulation 23C (Proper accounts to be kept)

10.1   Omit the regulation.

11.   Regulation 23D (Appointment and functions of auditor)

11.1   Omit the regulation.

12.   Regulation 23E (Annual report of the Board)

12.1   Omit the regulation, substitute:

Annual report

 “23E. An annual report prepared by the Board under section 9 of the Commonwealth Authorities and Companies Act 1997 must set out, for the period to which the report relates:

• (a)

  each policy guideline approved by the Minister by instrument under paragraph 4 (4) (d); and

• (b)

  each direction issued by the Minister under subregulation 20 (2).”.
