REASONS FOR JUDGMENT

Background

  1. Mr Nair of counsel objects to the tender of the affidavit by the first respondent and the documents being the subject of the s.375 certificate, exhibited to the affidavit.

  2. The documents are plainly relevant to ground 1 of the amended application. The documents are also relevant to the question of whether there is any substantial injustice. Accordingly, the affidavit and exhibit to the affidavit are admissible relevant evidence. I propose to admit the affidavit and the exhibit to the affidavit.
