I, the Minister for Urban Affairs and Planning, make the following local environmental plan under the Environmental Planning and Assessment Act 1979. (S00/00839/S69)

Armidale Local Environmental Plan 1988 (Amendment No 22)

1     What is this plan called?

This plan is called Armidale Local Environmental Plan 1988

(Amendment No 22).

2     What are the aims of this plan?

The aims of this plan are:

(a)	to rezone certain land to the Residential zone under Armidale Local Environmental Plan 1988 (the 1998 plan), and
(b)	to effect in the 1988 plan a change in the Council's name as a result of a recent amalgamation from Armidale City Council to Armidale Dumaresq Council, and
(c)	to correct an error in a reference to the Heritage Conservation map under the 1988 plan.

3     Where does this plan apply?

(1) To the extent that this plan rezones land, it applies to Lot 1, D.P. 774450 and so much of Kurrawatha Avenue, Armidale, as is shown coloured light scarlet with red edging on the map marked “Armidale Local Environmental Plan 1988 (Amendment No. 22)” deposited in the offices of Armidale Dumaresq Council.

(2) To the extent that this plan effects a change in the Council's name, it applies to all land to which Armidale Local Environmental Plan 1988 applies.

4 Amendment of Armidale Local Environmental Plan 1988

Armidale Local Environmental Plan 1988 is amended as set out in

Schedule 1.

(Clause 4)

[1]     Clause 5 Definitions

Omit “Council for the City of Armidale” from the definition of “council” in clause 5 (1).

Insert instead “Armidale Dumaresq Council”.

[2]     Clause 5 (1), definition of “zoning map”

Insert in appropriate order at the end of the definition:

[3]     Schedule 1 Heritage items

Omit “Armidale Local Environmental Plan 1988—Amendment No.

4—Heritage Conservation” from the Note to the Schedule.

Insert instead “Armidale Local Environmental Plan 1988—Amendment No.

7—Heritage Conservation”.
