1      Name of Plan

This Plan is Armidale Dumaresq Local Environmental Plan 2008

(Amendment No 6).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to the land to which Armidale Dumaresq Local Environmental Plan 2008 applies, particularly land within Zone Nos 1 (a), 1 (b) and 1 (c).

[1]      Clause 14 Zone No 1 (a) General Rural

Omit clause 14 (6). Insert instead:

(6)

Existing holdings

In this clause, existing holding means a holding that:

(a)

was a holding on 14 June 1985, and

(b)

has the same configuration as it had on 14 June 1985 at the time of lodging a development application for the erection of a dwelling house under this clause,

whether or not there has been a change in the ownership of the

holding since 14 June 1985.

[2]      Clause 14 (8) (c) and (d), 15 (7) (c) and (d) and 16 (7) (c) and (d)

Omit “within 3 years of the commencement of this Plan” wherever occurring.

Insert instead “before 15 February 2013”.

[3]      Clauses 14 (8) (c), 15 (7) (c), 16 (7) (c), 33 (7) (b) and 33 (7) (d)

Omit “4 June 1985” wherever occurring. Insert instead “14 June 1985”.

[4]      Clause 15 Zone No 1 (b) Rural Living

Omit “a lot” where first occurring in clause 15 (7) (b). Insert instead “land”.

Omit “the lot”. Insert instead “the land is a lot that”.

Omit the definition of holding. Insert instead:

holding means all adjoining land, even if separated by a road or

railway, held by the same person or persons.
