The applicants require a substantial extension of time within which to seek special leave to appeal from a judgment of the Court of Appeal of the Supreme Court of New South Wales (Ward P, Mitchelmore JA) made on 19 May 2023. The lengthy delay in seeking special leave to appeal is not adequately explained. The proposed appeal to this Court has insufficient prospects of success to justify the grant of special leave. It would therefore be futile to grant the extension of time that is sought.
Special leave to appeal is refused.
