  1. The applicant seeks special leave to appeal from a judgment of the Court of Appeal of the Supreme Court of New South Wales (Leeming JA, Payne JA and Griffiths A‑JA agreeing) allowing the respondent's appeal from a decision of the District Court of New South Wales (Andronos SC DCJ).

  2. The proposed appeal does not raise a question of law of general importance sufficient to warrant the grant of special leave to appeal. Further, it cannot be said that the interests of the administration of justice, either generally or in this case, weigh in favour of the grant of special leave.

  3. Special leave to appeal is refused with costs.
