  1. The applicants seek special leave to appeal from the whole of a judgment of the Court of Appeal of the Supreme Court of New South Wales (Macfarlan, White and McCallum JJA), dismissing appeals from a decision of the Supreme Court of New South Wales (Henry J).

  2. The applications are not suitable vehicles for consideration of the question of principle that is raised. If special leave to appeal were to be granted, the appeals would enjoy insufficient prospects of success. Accordingly, special leave should be refused.

  3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal orders dismissing the applications with costs.
