Architects Act 1991

Architects (Amendment) Regulations 2000

The Governor in Council approves the making of the
following Regulations by the Architects Registration Board
of Victoria:

The Architects Registration Board of Victoria makes the following Regulations:

1. Objective

The objective of these Regulations is to amend the
Architects Regulations 1993 in relation to—

Architects (Amendment) Regulations 2000

r. 2 S.R. No. 25/2000

(a)

the examination of practical architectural experience; and

(b)

the fees prescribed for examinations and other fees prescribed for the purposes of the Act; and

(c)

other minor matters required to improve the operation of those Regulations.

2. Authorising provisions

These Regulations are made under sections 46 and

69 of the Architects Act 1991.

3. Principal Regulations

In these Regulations the Architects Regulations

19931 are referred to as the Principal Regulations.

4. Application for approval as an architectural company

In regulation 17(3) of the Principal Regulations omit "the name of the principal executive officer of the company and".

5. Distribution of ballot paper

In regulation 35 of the Principal Regulations, for
paragraph (c) substitute—
"(c) an unsealed return envelope addressed to the

Returning Officer, with a place marked for the voter's name, address and signature; and".

6. Fees

In regulation 47 of the Principal Regulations, for
sub-regulations (2) to (6) substitute—

"(2) For the purpose of section 9(2)(b) of the Act

the fee for an application for registration is
$100.

(3) For the purpose of section 12(2)(b) of the Act the fee for an application for approval and registration of an architectural

partnership or an architectural company is

$120.

(4) For the purpose of section 15(1) of the Act

the annual fee is—

(a) for a retired architect, $30; and

(b)

for any other architect, architectural partnership or company, $150.

(5) For the purpose of section 15(4) of the Act

the additional fee for late payment is—

(a) for a retired architect $15;

(b)

for any other architect, approved architectural company, $45.

(6) For the purposes of the Act the fee for—

(a) a duplicate Certificate of Registration is $50;

(b) a copy of a page of the Register is $5; (c) a copy of the whole Register is $100.".

7. New regulation 48A inserted

After regulation 48 of the Principal Regulations insert—

"48A. Architectural Practice Examinations

For the purposes of section 10(b) of the Act, the Board may require a person wishing to be registered as an architect to undertake written and oral Architectural Practice Examinations conducted by the Board.".

8. Qualification in architecture

In regulation 49 of the Principal Regulations, for
paragraph (d) substitute—

"(d) any other course in Architecture which is

approved by the Board as being equivalent to
a course prescribed in paragraph (a), (b) or

(c).".

9. Rules for examination

In regulation 52 of the Principal Regulations, sub- regulation (2) is revoked.

10. Amendments to regulation 53

(1) In regulation 53 of the Principal Regulations, for

sub-regulation (1) substitute—

"(1) A candidate for an examination conducted

by the Board must pay the relevant

examination fee to the Board.".

(2) In regulation 53(2) of the Principal Regulations,

for "For the purpose of sub-regulation (1) the
examination fees are—" substitute "The
examination fees for the prescribed course of

study are—".

(3) After regulation 53(2) of the Principal

Regulations, insert—

"(3) The fees for the Architectural Practice

Examinations are—

(a) written examination, $250;

(b) oral examination, $250.".

11. Contents of the Register

In regulation 56(e) of the Principal Regulations omit ", principal executive officer".

12. Notification of changed information

(1) In regulation 57(1) of the Principal Regulations

for "name and address" substitute "name or

address".

(2) In regulation 57(3)(b) of the Principal Regulations

omit ", principal executive officer".

13. Schedule

For Part C of the Schedule to the Principal

Regulations substitute—

 Note:  A prescribed relative means a parent, spouse, de facto spouse,
child or grandchild of the architect director.

6.    Do the memorandum and articles of association of the company provide that the primary purpose of the company is the practice of architecture?

Note: This is a requirement under section 14(1) of the Architects Act

1991.
