1. Title
These Regulations may be cited as the Archaeological and Aboriginal Relics Preservation Regulations 1992.
2. Objectives
The objectives of these Regulations are—
(a)
to prescribe identity cards to be used in relation to the appointment of inspectors and wardens;
(b)
to prescribe information to be provided in an application for a permit to excavate for relics, the form of permit to be used, and conditions on permits;
(c)
to prescribe the form to be lodged by any person intending to undertake a site survey, and the information to be provided as a result of such a survey; and
(d)
to prescribe the fee for a permit to uncover, expose or excavate a relic.
3. Authorising provision
These Regulations are made under section 32 of
the Archaeological and Aboriginal RelicsPreservation Act 1972.

4. Definition
In these Regulations—
"the Act" means the Archaeological and
Aboriginal Relics Preservation Act 1972.
5. Revocation
The following Regulations are revoked—
(a) Archaeological and Aboriginal Relics
Preservation Regulations 1973—S.R. 12/73;(b) Archaeological and Aboriginal Relics
Preservation (Fees) Regulations 1975—
S.R. 230/75; and(c) Archaeological and Aboriginal Relics
Preservation (Amendment) Regulations
1980—S.R. 402/80.
6. Identity cards for inspectors and wardens
For the purposes of section 11 of the Act—
(a)
Form A in the Schedule is the prescribed form of identity card to be issued to an inspector; and
(b)
Form B in the Schedule is the prescribed form of identity card to be issued to a warden.
7. Excavation permits
(1) For the purposes of section 22 of the Act an
applicant seeking the consent of the Minister to disturb or excavate any land for the purpose of uncovering or discovering a relic must—
(a) furnish the following particulars—
(i) the full name and address of the applicant;

(ii) consideration, including its name and
a full description of the site under registration number;
(iii) full details of the location of the site, including its specific Australian Map Grid co-ordinates;
(iv) the full cadastral description of the land on which the site is located, along with details of its ownership and of any body
responsible for its administration;
(v) the proposed starting date and duration of the excavation;
(vi) a statement of the reasons why the site has been selected for excavation;
(vii) a description of the methodology excavation project; and
(viii) any other particulars required by the Minister in relation to the capacity of the applicant to carry out the excavation
project, and report upon the results
obtained, in accordance with the Act
and these Regulations; and
(b)
certify the correctness of the particulars supplied.
(2) A permit authorising the uncovering or exposing
of any relic or the excavation of any relic must—
(a) be in or to the effect of Form C in the Schedule; and (b) be issued subject to the conditions that the person to whom the permit is granted shall— (i) be fully responsible for the manner in which the excavation in conducted;

(ii) ensure that portable relics excavated conserved and stored; and
(iii) ensure that the site is properly restored and stabilised following the excavation.
8. Fee for a permit to excavate for relics
For the purposes of section 22(2) of the Act the prescribed fee for a permit to excavate land for the purpose of uncovering or discovering a relic is $12.
9. Site survey information
For the purposes of section 22(5) of the Act—
(a) notification to the Secretary of intention to undertake a survey must be in or to the effect of Form D in the Schedule; and (b) site information collected during a survey must be provided to the Secretary as follows— (i) a completed record for each individual site, in or to the effect of Form E, F, G or H in the Schedule (whichever is
relevant); and
(ii) two (2) final copies of any report which may result from the survey.

1. General Information
The Archaeological and Aboriginal Relics Preservation Regulations 1992, S.R. No. 218/1992 were made on 15 July 1992 by the Governor in Council under section 32 of the Archaeological and Aboriginal Relics Preservation
Act 1972, No. 8273/1972 and came into operation on 15 July 1992.
The Archaeological and Aboriginal Relics Preservation Regulations 1992 will sunset on 14 July 2003: see the Subordinate Legislation (Archaeological and Aboriginal Relics Preservation Regulations 1992—Extension of Operation) Regulations 2002, S.R. No. 40/2002.
