Aquatic Resources Legislation Amendment Act 2016

An Act to amend the Aquatic Resources Management Act 2016 and the Fishing Industry Promotion Training and Management Levy Act 1994.

[Assented to 29 November 2016]

The Parliament of Western Australia enacts as follows:

Part 1 – Preliminary1.Short title

This is the Aquatic Resources Legislation Amendment Act 2016.

2.Commencement

This Act comes into operation as follows —

• (a)

  Part 1 — on the day on which this Act receives the Royal Assent;

• (b)

  Part 2 — on the day on which the Aquatic Resources Management Act 2016 section 263 comes into operation;

• (c)

  Part 3 — on the day on which the Aquatic Resources Management Act 2016 section 267 comes into operation.

Part 2 – Aquatic Resources Management Act 2016 amended3.Act amended

This Part amends the Aquatic Resources Management Act 2016.

4.Section 263 amended

After section 263(5) insert:

• (6)

  To the extent that the regulations prescribe under subsection (2)(j) a fee that includes an amount referred to in subsection (5) that is a tax, the regulations may impose the tax.

   

Part 3 – Fishing Industry Promotion Training and Management Levy Act 1994 amended5.Act amended

This Part amends the Fishing Industry Promotion Training and Management Levy Act 1994.

6.Section 5 replaced

Delete section 5 and insert:

5. Levy imposed

If an amount by way of levy is prescribed in respect of a licence or resource share, that levy is imposed in respect of the licence or resource share.
