Appropriation (Parliamentary Departments) Act (No. 2) 1989-90

An Act to appropriate a sum out of the Consolidated Revenue Fund, additional to the sums appropriated by the Appropriation (Parliamentary Departments) Act 1989-90, for certain expenditure, in relation to the Parliamentary Departments, in respect of the year ending on 30 June 1990, and for other purposes

BE IT ENACTED by the Queen, and the Senate and the House of Representatives of the Commonwealth of Australia, as follows:

Short title

1. This Act may be cited as the Appropriation (Parliamentary Departments) Act (No. 2) 1989-90.

Commencement

2. This Act commences on the day on which it receives the Royal Assent.

Issue and application of $9 769 000

3. The Minister for Finance may issue out of the Consolidated Revenue Fund and apply for the services specified in the Schedule, in respect of the year ending on 30 June 1990, the sum of $9 769 000.

Appropriation

4. The sum authorised by this Act to be issued out of the Consolidated Revenue Fund, is appropriated, and is taken to have been appropriated as from 1 July 1989, for the services specified in the Schedule in respect of the financial year that commenced on that date.

Additional appropriation in respect of increases in salaries

5. Section 5 of the Appropriation (Parliamentary Departments) Act 1989-90 has effect, on and from the commencement of this Act, as if the reference in that section to Schedule 2 to that Act included a reference to the Schedule to this Act.

Net annotated appropriations

6. Where the description of the purpose of an appropriation set out in an item, subdivision or Division of the Schedule concludes with the words "(net appropriation—see section 6)", that Schedule is taken, for the purposes of this Act and the Audit Act 1901, to provide that all money received:

  1. (a)

    from the sale, leasing or hiring out of, or other dealing with, goods or personal property; or

  2. (b)

    from the sale of real property used for the purpose of providing staff residential accommodation or from the leasing of real property for that purpose; or

  1. (c)

    from the provision of services;

may be credited to that item, subdivision or Division, to such extent as is, and on such conditions as are, agreed between the Minister responsible for the Department, statutory authority, or other body for which the appropriation is made and the Minister for Finance.

To enable the President of the Senate to make money available for expenditure:

(i) that the President of the Senate is satisfied is expenditure that is urgently required and:

(A) was unforeseen until after the last day on which it was practicable to include appropriation for that expenditure in the Bill for this Act before the introduction of that Bill into the House of Representatives; or

(B) was erroneously omitted from, or understated in, the Bill for this Act; and

(ii) particulars of which will afterwards be submitted to the Parliament;
