Appropriation Act (No. 2) 1995-96

An Act to appropriate $14,200,000 out of the Consolidated Revenue Fund for expenditure for services provided by the Department of Health and Community Care in respect of the year ending 30 June 1996

The Legislative Assembly for the Australian Capital Territory enacts as follows:
Short title
1. This Act may be cited as the Appropriation Act (No. 2) 1995-96.
Commencement
2. This Act commences on the day on which it is notified in the Gazette.
Interpretation
3. In this Act, unless the contrary intention appears—
“financial year” means the year that commenced on 1 July 1995.
Issue and application of $14,200,000
4. The Treasurer may issue the sum of $14,200,000 out of the Consolidated Revenue Fund and apply it in respect of services provided in the financial year by the appropriation unit specified in the Schedule.
Appropriation of $14,200,000—Health and Community Care
5. The sum of $14,200,000 authorised to be issued out of the Consolidated Revenue Fund by section 4 of this Act, as specified in the second column in Part I of the Schedule, is to be taken to have been appropriated on 1 July 1995 for services provided in the financial year by the Health and Community Care appropriation unit, as specified in the first column in Part I of the Schedule.
Appropriations for appropriation units
6. Money appropriated by this Act for services provided by a particular appropriation unit is to be taken to be appropriated for—
(a)the purpose of payments (including advances) under Acts administered by that unit; and
(b)other purposes of the appropriation unit, being purposes for which appropriation has been made in an earlier Act.
Net appropriations
7. (1) For the purposes of this Act and subsection 44 (3) of the Audit Act 1989, where the description of the purpose of an appropriation in favour of an administrative unit under an item in Part II of the Schedule includes the words “net appropriation—see section 7”, the Schedule is to be taken to provide that all money received by that administrative unit from an administrative unit for the provision of services in pursuance of that purpose may be credited to that item.
(2) Where, by virtue of subsection (1), money is to be taken to be credited to an item in Part II of the Schedule, that money is to be taken to be credited only—
(a)to the extent agreed between the Treasurer and the Minister responsible for the administration of that item; and
(b)on the conditions (if any) agreed between the Treasurer and that Minister.
(3) In this section—
“administrative unit” includes a Territory authority.
