APPROPRIATION (No. 2) ACT.
Act No. 51, 1928.
An Act to appropriate and apply out of the Con solidated Revenue Fund of New South Wales certain Sums to make good the Supplies granted for the Service of the year from the
1st day of Ju ly , 1928, to the 30th day of June , 1929 (inclusive of both dates); to adjust the
vote " Advance to Treasurer," 1927-28 , Con solidated Revenue Fund, for supplementary charges during the period from the 1st day
of Ju ly , 1927, to the 30th day of June, 1928
(inclusive of both dates); to cover payments
" Unauthorised in Suspense," Consolidated
Revenue Fund, for urgent claims on account of Services of the year 1927-28 ; to provide
for Services out of the Closer Settlement
Fund ; to appropriate and apply out of the Government Railways and Tramways Fundfor the Service of the year from the first day
of Ju ly , one thousand nine hundred andtwenty-eight, to the thirtieth day of June , one thousand nine hundred and twenty-nine (inclusive of both dates) ; to appropriate and apply out of the Sydney Harbour Trust Fund
objects. [Assented to, 29th December, 1928.] WHEREAS for the Service of the year from the first day
of Ju ly , one thousand nine hundred and
twenty-eight, to the thirtieth day of June , one thousand nine hundred and twenty-nine (inclusive of both dates) ; and for purposes connected with and incidental to the above
Assembly of New South Wales in Parliament assembled WHEREAS we Your Majesty's most dutiful and loyal subjects, the members of the Legislative have granted to Your Majesty the several sums herein after mentioned for the Service of the year from the first day of July, one thousand nine hundredand twenty-eight, to the thirtieth day of June, one thousand nine hundred and twenty-nine (inclusiye of both dates), and for supplementing the grants made by the present Parlia ment, in its Third Session, in adjustment of the vote " Advance to Treasurer," 1927-28, Consoli lated Revenue Fund, for supplementary charges during the period from the first day of July, one thousand nine hundred and twenty-seven, to the thirtieth day of June, one thousand nine hundred and twenty-eight (inclusive of both dates) ; to cover payments "Unauthorised in Suspense," for urgent claims on account of Services of the year 1927-
28, to be provided for out of the Consolidated Revenue Fund; for Services to be provided for out of the Closer Settlement Fund ; for Services to be provided for out of the Government Railways and Tramways Fund; and
for Services to be provided for out of the Sydney Harbour Trust Fund : And whereas we desire to make good out of the said funds the several sums granted to Your Majesty as aforesaid: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice
and consent of the Legislative Council and Legislative Assembly of the State of New South Wales in Parlia ment assembled, and by the authority of the same, as

Subject to Section thirty-four of the Audit Act and the following proviso, expenditure shall not be incurred on any item, subdivision, division or vote, shown on the Estimates of the Consolidated Revenue Fund, the Government Railways and Tramways Fund, and the Sydney Harbour Trust Fund, in excess of the sum pro vided therefor by Parliament on such Estimates— provided that if the exigencies of the Public Service render it necessary, the Colonial Treasurer or person appointed by him may authorise the transfer of a specific amount from any item, subdivision or division, other than for specific public works, to any other item,
subdivision or division, within the same vote other than
for specific public works.
Nothing in this proviso shall empower the Colonial Treasurer or the person appointed by him as aforesaid to authorise the transfer of any sum in augmentation of or as an addition to any salary or wages the amount of which has been fixed by law.
The Colonial Treasurer shall cause the Auditor- General to be informed of every such authority granted as aforesaid.
There shall be issued and paid the said several sums for the purposes hereinbefore mentioned in such manner and in such proportions as the Governor by any warrant or order in writing under his hand and directed to the Colonial Treasurer or other lawful authority may from time to time order and direct, and the payments so to be made shall be charged upon and payable out the said

funds respectively; but the said Colonial Treasurer
in connection with any of the State Departments trans shall not be held liable for any claims which may arise ferred to the Commonwealth on or after the date of such
transfer.7 . The said Colonial Treasurer or other lawful Authority shall in their respective accounts from time to time be allowed credit for any sum or sums of money paid by him or them in pursuance of such warrant or order in writing as aforesaid, and the receipts of the respective persons to whom the same are so paid shall be a full and valid discharge to the said Colonial
Treasurer
Treasurer or other lawful Authority in passing the said accounts for any such sums as may be therein men- tioned, and he or they shall receive credit for the same accordingly.
8 . This Act mav be cited as the "Appropriation Act (No. 2), 1928."
