An Act for applying certain Sums arising from the Revenue receivable in New South Wales to the Service thereof for the Year One thousand eight hundred and thirty-six and for further appropriating the said Revenue. [25th August, 1835.]

" effectual Government thereof and other purposes relating thereto"
it was amongs t o ther t h i n g s enacted T h a t all and every t h e powers
and au thor i t i e s vested by cer ta in o ther Ac t s of P a r l i a m e n t the re in
referred to or e i ther of t h e m in t h e Governor of N e w Sou th Wales
or t h e person admin i s t e r ing t h e Gove rnmen t thereof should thence­
forth be vested in a n d exercised by t h e said Governor ac t ing wi th t he
advice a n d consent of t h e Legis la t ive Counci l of t h e said Colony and

t h a t t h e p roduce of t h e several dut ies imposed and m a d e payable u n d e r and by v i r tue of t he said recited Acts there in referred to and also u n d e r and by v i r t ue of t h a t A c t should be applied in such m a n n e r and

to such purposes as t h e said Governor and Counci l should from t i m e
t o t i m e by any L a w or Ordinance appoin t Be i t therefore enacted

by H i s Excel lency t h e Governor of N e w South W a l e s w i t h t he advice and consent of t he Legis la t ive Council thereof Tha t out of t h e p roduce of t h e said dut ies the re shal l a n d may be issued a n d applied any sum or sums of money no t exceeding t en thousand two h u n d r e d and one pounds seventeen shil l ings and ten-pence for t he service of t h e year one t h o u s a n d eight h u n d r e d and th i r ty- four to supply t he

deficiencies in t h e a m o u n t appropr ia ted for t h e same.

A n d be i t enacted Tha t out of t h e produce of t h e said dut ies the re shal l and m a y be issued and applied any s u m or sums of money n o t exceeding twenty-four t housand four hund red a n d n ine ty- one pounds two shil l ings and ten-pence for defraying t h e supple­ m e n t a r y charge for t h e service of t he year one t h o u s a n d e ight h u n d r e d a n d thirty-five as hereinafter more pa r t i cu la r ly expressed t h a t is t o say any s u m or sums of money n o t exceeding four t housand pounds to defray the supp lemen ta ry expense of t h e Depa r t ­ m e n t of t h e Cus toms and any s u m or sums of money no t exceeding four t housand one h u n d r e d and sixteen pounds fifteen shillings and eight-pence to defray t he supplementary expense of t he R o a d B r a n c h of t he Surveyor Genera l ' s D e p a r t m e n t and any s u m or sums of money no t exceeding t h r e e t housand seven h u n d r e d and n ine ty- th ree pounds two shil l ings and eight-pence to defray t h e supplementary expense of t he Sydney Town B r a n c h of t h e Surveyor Genera l ' s Depar t ­

3. A n d be it enacted T h a t out of t he produce of t h e said dut ies t he r e shall and may be issued and appl ied any s u m or sums of money no t exceeding twen ty thousand pounds towards defraying t h e charge of t he Police and Gaol Es t ab l i shmen t s of N e w Sou th Wales for t h e

year one t housand eight h u n d r e d and thir ty-five.

4. A n d be it enac ted Tha t there shall and m a y be issued and applied any s u m or sums of money no t exceeding e ight t housand pounds towards defraying t h e expenses incur red unde r t h e direction of H i s Majesty 's Governmen t for p r o m o t i n g t h e E m i g r a t i o n of free

Persons from the U n i t e d K i n g d o m of Grea t Br i t a in and I r e l a n d to
t h e Colony for t h e year one t h o u s a n d eight h u n d r e d and th i r t y -
five.
5. A n d be i t enacted T h a t ou t of t h e p roduce of t he said dut ies

t he r e shall and may be issued and appl ied any s u m or sums of money

H a r b o u r of P o r t J a c k s o n and any sum or sums of money no t exceed­
ing two h u n d r e d pounds to defray t h e expense of t h e Aus t r a l i an

M u s e u m and any s u m or sums of money no t exceeding twenty-five pounds to defray t he salary of t h e Housekeeper of t h e Pub l i c Offices in Macquar ie -s t ree t Sydney and any s u m or sums of money not exceeding n ine h u n d r e d and fifty pounds to defray t he salaries of t he Colonial A g e n t General and of t he Br i t i sh Res ident a t N e w Zealand

A n d be i t enacted Tha t out of t he produce of t h e said dut ies the re shall a n d m a y be issued and applied any s u m or sums of money not exceeding six hundred and sixty-four pounds t en shil l ings and sixpence to defray t h e expense of t h e Mi l i t a ry Es t ab l i shmen t of t he said Colony for t h e year one thousand e ight hundred and th i r ty-s ix .

thousand eight h u n d r e d and th i r ty-s ix .

12. And be i t enacted Tha t out of t he produce of the said duties the re shall and may be issued and applied any s u m or sums of money n o t exceeding th i r ty -n ine thousand n ine h u n d r e d and forty-six pounds for defraying t h e charge for Miscel laneous Services of t h e said Colony for t he year one thousand eight hund red and th i r ty -s ix as hereinafter m o r e pa r t i cu la r ly expressed t h a t is to say any sum or sums of money not exceeding seven h u n d r e d and fifty pounds to defray live charge of an al lowance to the Honorable Alexander M ' L e a y Esqu i r e in fulfil­ m e n t of an agreement wi th t h e R i g h t Honorab le t he Secretary of of S ta te for t he Colonies and any sum or sums of money no t exceeding two t h o u s a n d one h u n d r e d pounds to defray t h e expense of S ta t ionery

14. A n d be it enacted T h a t out of t he p roduce of t h e said dut ies the re shall and may be issued and applied any s u m or sums of money not exceeding two thousand pounds to t h e Governor for t he t ime-be ing of t he said Colony to be appl ied to meet unforeseen expenses on occasions of emergency for t h e year one thousand e ight h u n d r e d

a n d th i r ty-s ix .
15. A n d be i t enacted Tha t t h e Treasurer of t h e said Colony

shall issue and pay the said several sums to such persons for t h e pur ­ poses hereinbefore ment ioned upon such days a n d in such propor t ions as t h e Governor for t he t ime-be ing by any w a r r a n t or order in wr i t ing to be signed by h im shall from t ime to t ime order and direct a n d t h a t t h e paymen t s so to be made shall be m a d e upon and payable out of t h e Revenues of t he said Colony.

16. A n d be i t enacted T h a t t h e said Treasure r shall in his

accounts from t i m e to t ime be allowed credit for any sum or sums of

money paid by h im in pu r suance of such w a r r a n t or order in wr i t ing

as aforesaid a n d t h a t the receipt or receipts of t h e respective persons to w h o m the same shall be so paid shall be a full and valid discharge to t h e said Treasurer in pass ing his said accounts for any such s u m or sums as shal l be there in ment ioned and t h a t he shall and do receive credit for t he same accordingly.
