An Act to appropriate money for the purposes of the Territory for the financial year beginning on 1 July 2009, and for other purposes
The Legislative Assembly for the Australian Capital Territory enacts as follows:
Name of Act
This Act is the Appropriation Act 2009-2010.
Commencement
This Act is taken to have commenced on 1 July 2009.
NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).
Purposes of Act
This Act is made for the purposes of—
(a)the Self-Government Act, section 57 and section 58; and
(b)the Financial Management Act, section 6 and section 8.
Definitions for Act
In this Act:
agency means a department, territory authority or territory-owned corporation.
Financial Management Act means the Financial Management Act 1996.
financial year means the year beginning on 1 July 2009.
Terms used in Financial Management Act
A term used in the Financial Management Act has the same meaning in this Act.
Appropriations of $3 723 951 000
(1)If an agency is mentioned in a part of schedule 1, column 1—
(a)the amount mentioned in that part, column 3 is appropriated to the agency for the net cost of providing outputs in the financial year for the appropriation unit mentioned in that part, column 2 (the relevant appropriation unit);
(b)the amount mentioned in that part, column 4 is appropriated to the agency for capital injection in the financial year for the relevant appropriation unit; and
(c)the amount mentioned in that part, column 5 is appropriated to the agency for payments to be made on behalf of the Territory in the financial year for the relevant appropriation unit.
(2)The amount mentioned in schedule 1, part 1.26, column 6 is appropriated to the Treasurer’s Advance for the Financial Management Act, section 18.
Appropriation units and output classes
(1)A group of outputs mentioned in schedule 2, column 2 is identified as a class of outputs for the Financial Management Act.
(2)An appropriation unit mentioned in schedule 2, column 1 consists of the classes of outputs, or the group of output classes, mentioned in that schedule, column 2 opposite the appropriation unit.
Net appropriations for capital injections
For the Financial Management Act, section 9A, the appropriations for capital injections mentioned in schedule 1 (except the appropriations for capital injections mentioned in part 1.9 and part 1.10) are for, or partly for, the net cost of purchasing or developing assets.
Commonwealth grants
The Financial Management Act, section 17 applies to all appropriations under this Act, section 6, except the appropriations to the following agencies:
(a)Legislative Assembly Secretariat;
(b)ACT Executive;
(c)Auditor-General;
(d)Chief Minister’s Department;
(e)Shared Services Centre;
(f)Home Loan Portfolio;
(g)Superannuation Provision Account;
(h)Territory Banking Account;
(i)Department of Justice and Community Safety;
(j)ACT Planning and Land Authority;
(k)ACT Gambling and Racing Commission;
(l)ACT Insurance Authority;
(m)Cultural Facilities Corporation;
(n)Independent Competition and Regulatory Commission;
(o)Public Trustee for the ACT.
Payments to the Commonwealth
The Financial Management Act, section 17A applies to the appropriation mentioned in schedule 1, part 1.14, column 5.
Superannuation appropriation
For the Territory Superannuation Provision Protection Act 2000, dictionary, definition of superannuation appropriation, the appropriation mentioned in schedule 1, part 1.9, column 4 is for superannuation.
