An Act to appropriate money for the purposes of the Territory for the financial year beginning on 1 July 2002 and for other purposes

Notified under the Legislation Act 2001 on 9 September 2002


(see Legislative Assembly for the Australian Capital Territory enacts as follows:

  1. Name of Act

    This Act is the Appropriation Act 2002-2003.

  2. Commencement

    This Act is taken to have commenced on 30 June 2002.

  3. Purposes of Act

    This Act is made for the purposes of—

    (a)the Australian Capital Territory (Self-Government) Act 1988 (Cwlth), sections 57 and 58; and

    (b)the Financial Management Act, sections 6 and 8.

  4. Definitions for Act

    In this Act:

    Financial Management Act means the Financial Management Act 1996.

    financial year means the year beginning on 1 July 2002.

  5. Words and expressions used in Financial Management Act

    A word or expression used in the Financial Management Act has the same meaning in this Act.

  6. Appropriations of $ 1 963 714 000

  7. If a department is mentioned in column 1 in a part of schedule 1—

    (a)the amount mentioned in column 3 in that part is appropriated to the department for the net cost of providing outputs in the financial year for the appropriation unit mentioned in column 2 in the part; and

    (b)the amount mentioned in column 4 in that part is appropriated to the department for capital injection in the financial year for the appropriation unit mentioned in column 2 in the part; and

    (c)the amount mentioned in column 5 in that part is appropriated to the department for payments to be made on behalf of the Territory in the financial year for the appropriation unit mentioned in column 2 in the part.

  8. The amount mentioned in schedule 1, part 19, column 6 is appropriated to the Treasurer’s advance for the Financial Management Act, section 18.

  9. Appropriation units and output classes

  10. A group of outputs mentioned in schedule 2, column 2 is identified as a class of outputs for the Financial Management Act.

  11. An appropriation unit mentioned in schedule 2, column 1 consists of the classes of outputs, or the group of output classes, mentioned in column 2 of that schedule opposite the appropriation unit.

  12. Net appropriations for capital injections

    For the Financial Management Act, section 9A, it is stated that all the appropriations for capital injections mentioned in schedule 1 (except the appropriations for capital injections mentioned in parts 7 and 10) are for, or partly for, the net cost of purchasing or developing assets.

  13. Commonwealth specific purpose payments

    The Financial Management Act, section 17 applies to all appropriations under this Act, section 6 (1), except the appropriations to the following departments:

    (a)Legislative Assembly Secretariat;

    (b)ACT Executive;

    (c)Auditor-General;

    (d)Central Financing Unit;

    (e)Home Loan Portfolio;

    (f)InTACT;

    (g)Superannuation Unit;

    (h)Land;

    (i)ACT Forests;

    (j)ACT Workcover.

  14. Payments to the Commonwealth

    The Financial Management Act, section 17A applies to the appropriation mentioned in schedule 1, part 17, column 5.

  15. Superannuation appropriation

    For the Territory Superannuation Provision Protection Act 2000, dictionary, definition of superannuation appropriation, it is declared that the appropriations mentioned in schedule 1, part 10, columns 4 and 5 are appropriations for superannuation.
