NEW SOUTH WALES

Act No. 99, 1986

An Act to appropriate out of the Consolidated Fund and the Road Transport and Traffic Fund sums for the recurrent services and capital works and services of the Government for the year 1986-87 and sums for supplementary charges and payments under section 22 of the Public Finance

and Audit Act 1983 from the Consolidated Fund for the year 1985-86; and for certain other purposes. [Assented to 18 November 1986.]
Appropriation 1986

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:

PART 1

PRELIMINARY

Short title

1. This Act may be cited as the "Appropriation Act 1986".

Interpretation

2.  In this Act -

(a)

a reference to the year 1985-86 is a reference to the year from 1 July 1985 to 30 June 1986;and

(b)

a reference to the year 1986-87 is a reference to the year from 1 July 1986 to 30 June 1987.

PART 2

APPROPRIATIONS OUT OF THE CONSOLIDATED FUND

DIVISION 1 - Appropriations for recurrent services for the year 1986-87

General appropriation from Consolidated Fund 1986-87 for recurrent services

3. (1) Out of the Consolidated Fund there are hereby appropriated the
sums identified in sections 4 to 24, inclusive, as the sums appropriated by this
Act, which sums may be issued and applied for or towards the several uses and purposes expressed in those sections for the ordinary annual services of the
Government for the year 1986-87.
(2) The total sum appropriated out of the Consolidated Fund for the
ordinary annual services of the Government for the year 1986-87, in accordance
with the provisions of sections 4 to 24, inclusive, is the sum of $9,125,742,000.

(3) Any amounts expended under section 25 of the Public Finance and Audit Act 1983 or any Supply Act on or after 1 July 1986 and before the date of assent to this Act shall be deemed to have been expended out of such of the sums set out in sections 4 to 24. inclusive, as may be determined by the Treasurer.

Payments under section 22 of the Public Finance and Audit Act 1983, 1985-86

45. The sum of $281,278,000 is hereby appropriated out of the Consolidated Fund to provide for the payments specified in Schedule 2 made in anticipation of appropriation by Parliament during the year 1985-86, pursuant to determinations by the Treasurer, with the approval of the Governor, under section 22 (1) of the Public Finance and Audit Act 1983.

PART 3

APPROPRIATIONS OUT OF THE ROAD TRANSPORT AND TRAFFIC

FUND

Appropriations out of the Road Transport and Traffic Fund, 1986-87

46.     (1) The sum of $190,598,000 is hereby appropriated out of the Road

Transport and Traffic Fund for the ordinary annual services of the Government for the year 1986-87 and may be issued and applied for or towards the several uses and purposes specified in Schedule 3.

(2) The sum of $5,590,000 is hereby appropriated out of the Road Transport and Traffic Fund for the capital works and services of the Government for the year 1986-87.

PART 4

GENERAL

Variation of authorised expenditure from Consolidated Fund

47.     (1) Except as provided by Division 4 of Part II of the Public Finance

and Audit Act 1983 and subsections (2) and (3), expenditure of the sums appropriated under sections 4 to 24, inclusive, and sections 26 to 43, inclusive, shall not be incurred on any item or program shown in the Estimates of the Consolidated Fund in excess of the sum provided therefor in those Estimates.
(2) Where an item or program referred to in subsection (1) includes or comprises amounts appropriated otherwise than by this Act—

(a)

nothing in subsection (1) shall restrict the lawful expenditures of those amounts; and

(b) subsection (1) shall apply to the sums provided for in the Estimates exclusive of those amounts.

If the exigencies of the Public Service render it necessary, the Treasurer

or a person appointed by the Treasurer may, in respect of the appropriations
referred to in subsection (1), authorise—

(3)

(a) the transfer of a specific amount from the recurrent services appropriation for any item or program to the recurrent services appropriation for any Other item or program within the same organisational unit; and
(b) the transfer of a specific amount from the capital works and services appropriation for any item or program to the capital works and services appropriation for any other item or program.

Nothing in subsection (3) enables the authorisation of the transfer of an amount appropriated otherwise than by this Act.

(4)

Variation of authorised expenditure from the Road Transport and Traffic Fund

48.     (1) Subject to subsection (2), expenditure shall not be incurred on any

item shown in Schedule 3 in excess of the sum provided therefor in that
Schedule.

If the exigencies of the Public Service render it necessary, the Treasurer or a person appointed by the Treasurer may, in respect of the appropriations referred to in subsection (1), authorise the transfer of a specific amount from the recurrent services appropriation for any item to the recurrent services appropriation for any other item.

(2)

Transfers in relation to commitments

49.     (1) Where goods or services chargeable to an appropriation under this

Act have not been paid for in whole or in part by 30 June 1987, the Treasurer or a person appointed by the Treasurer, if the Treasurer or person is of the opinion that the goods or services might reasonably have been expected to be paid for by 30 June 1987, may approve the transfer of the amount involved to the credit of a suspense account within the Special Deposits Account, and the amount so transferred shall thereafter, except as provided by subsection (3), be

applied in or towards meeting the cost of the goods or services.

(2) Any amount transferred under subsection (1) shall, notwithstanding section 23(1) of the Public Finance and Audit Act 1983, be deemed to have been applied during the year 1986-87.

(3) Any amounts or portions of amounts transferred under subsection (1) which have not been applied for the purpose required by 30 September 1987 shall be repaid to the Consolidated Fund.

(4) The Treasurer shall, as soon as practicable after 30 June 1987. prepare a statement accounting for transfers made under subsection (1) for inclusion in the Public Accounts, being the Accounts prepared by the Treasurer under section 6(1) of the Public Finance and Audit Act 1983.

Appropriation 1986

Provisions affecting sections 47 to 49

50. (1) Nothing in section 47 or 48 shall empower the Treasurer or a person appointed by the Treasurer as referred to in those sections to authorise the transfer of any sum in augmentation of or as an addition to any salary or wages the amount of which has been fixed by law.

(2) The Treasurer shall cause the Auditor-General to be informed of every authority granted pursuant to section 47 or 48.

(3) Any appointment made under section 47, 48 or 49 shall be subject to such conditions, if any, as the Treasurer may determine.

(4) The Treasurer may revoke, at any time, an appointment made under section 47, 48 or 49.
