Act No. 114, 1984.

An Act to appropriate out of the Consolidated Fund and the Road Transport and Traffic Fund sums for the recurrent services and capital works and services of the Government for the year from 1st July, 1984, to 30th June, 1985, and sums for supplementary charges and payments under section 22 of the Public Finance and Audit Act, 1983, from those Funds for the year from 1st July, 1983, to 30th June, 1984; and for

certain other purposes. [Assented to, 31st October, 1984.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows: —

1.      This Act may be cited as the "Appropriation Act., 1984".

DIVISION 1.—Appropriations for recurrent services for the year 1984-1985.

General appropriation from Consolidated Fund 1984-1985 for recurrent services.

(1) Out of the Consolidated Fund there are hereby appropriated the sums set out in sections 4 to 26, inclusive, which sums may be issued and applied for or towards the several uses and purposes expressed in those sections for the ordinary annual services of the Government for the year from 1st July, 1984, to 30th June, 1985.

(2) Any amounts expended under section 25 of the Public Finance and Audit Act, 1983, or any Supply Act on or after 1st July, 1984, and before the date of assent to this Act shall be deemed to have been expended out of such of the sums set out in sections 4 to 26, inclusive, as may be determined by the Treasurer.

PART III.

APPROPRIATIONS OUT OF THE ROAD TRANSPORT AND TRAFFIC FUND.

Appropriations out of the Road Transport and Traffic Fund for 1984-1985.

The sum of $175,658,000 is hereby appropriated out of the Road Trans- port and Traffic Fund for the ordinary annual services of the Government for the year from 1st July, 1984, to 30th June. 1985, and may be issued and applied for or towards the several uses and purposes hereinafter expressed: — $

PART IV.

GENERAL.

Variation of authorised expenditure from Consolidated Fund—appropriations under sections 4-9.

(1) Except as provided by Division 4 of Part II of the Public Finance and Audit Act, 1983, and subsection (2), expenditure in respect of the appropriations under sections 4 to 9, inclusive, shall not be incurred—

(a) on any program shown in the Estimates of the Consolidated Fund in excess of the sum shown as the Annual Appropriation therefor in those Estimates;
(b) in respect of any amount shown within any such program in those Estimates in excess of that amount; or
(c) on any item or division shown in those Estimates for an organisational unit in excess of the sum provided therefor in those Estimates.

(2) If the exigencies of the Public Service render it necessary, the Treasurer or a person appointed by the Treasurer may, in respect of the appropriations referred to in subsection ( 1), authorise—

(a) the transfer of an amount within a program of an organisational unit;

(b)

the transfer of an amount from one program of an organisational unit to another program of the organisational unit; or

(c)

the transfer of an amount from any item or division shown in those Estimates for an organisational unit to any other item or division of the organisational unit.

(3) Nothing in subsection (2) enables the authorisation of the transfer

of—

(a) an amount appropriated otherwise than by this Act; or

(b) an amount shown in the Estimates of the Consolidated Fund to be

provided for "Other Services".

Variation of authorised expenditure from Consolidated Fund—appropriations under sections 10-45.

(1) Except as provided by Division 4 of Part II of the Public Finance and Audit Act. 1983. and subsection (2), expenditure in respect of the appropriations under sections 10 to 45, inclusive, shall not be incurred on any item, division or vote shown in the Estimates of the Consolidated Fund in excess of the sum provided therefor in those Estimates.

(2) If the exigencies of the Public Service render it necessary, the Treasurer or a person appointed by the Treasurer may, in respect of the appropriations referred to in subsection (1) authorise—

(a)

the transfer of a specific amount from the recurrent services appropri- ation for any item or division, other than for an item under the division "Other Services", to the recurrent services appropriation for any other item or division within the same vote, other than for an item under the division "Other Services"; and

(b)

the transfer of a specific amount from the capital works and services appropriation for any item to the capital works and services appropria- tion for any other item.

Variation of authorised expenditure from the Road Transport and Traffic Fund.

52. (1) Subject to subsection (2), expenditure shall not be incurred on any division shown in the Estimates of the Road Transport and Traffic Fund in excess of the sum provided therefor in those Estimates.

(2) If the exigencies of the Public Service render it necessary, the Treasurer or a person appointed by the Treasurer may authorise the transfer of a specific amount from any division within the vote, other than for specific capital works and services, to any other division within the vote, other than for specific capital works and services.

Provisions affecting sections 50, 51 and 52.

(1) Nothing in sections 50, 51 and 52 shall empower the Treasurer or a person appointed by the Treasurer as referred to in those sections to authorise the transfer of any sum in augmentation of or as an addition to any salary or wages the amount of which has been fixed by law.

53.

(2) The Treasurer shall cause the Auditor-General to be informed of every authority granted pursuant to section 50, 51 or 52.
