Act No. 109, 1983.
An Act to appropriate out of the Consolidated Fund and the Road Transport and Traffic Fund sums for the recurrent services and capital works and services of the Government for the year commencing on 1st July, 1983, and ending on 30th June, 1984, and sums for supplementary charges and payments "Unauthorised in Suspense" from those Funds for the year from 1st July, 1982, to 30th June, 1983; and for certain other purposes.

Appropriation.
BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

1. This Act may be cited as the "Appropriation Act, 1983".

APPROPRIATIONS OUT OF THE CONSOLIDATED FUND.
DIVISION 1.—Appropriations for recurrent services for the year 1983-1984.
General appropriation from Consolidated Fund 1983-1984 for recurrent services.
(1) Out of the Consolidated Fund there are hereby appropriated the sums set out in sections 4 to 23, inclusive, which sums may be issued and applied for or towards the several uses and purposes expressed in those sections for the ordinary annual services of the Government for the year from 1st July, 1983, to 30th June, 1984.

(2) Any amounts expended under section 33 of the Audit Act, 1902, or any Supply Act on or after 1st July, 1983, and before the date of assent to this Act shall be deemed to have been expended out of such of the sums set out in sections 4 to 23, inclusive, as may be determined by the Treasurer.

PART III.
APPROPRIATIONS OUT OF THE ROAD TRANSPORT AND TRAFFIC FUND.
Appropriations out of the Road Transport and Traffic Fund for 1983-1984.
43. (1) The sum of $138,700,000 is hereby appropriated out of the Road Transport and Traffic Fund for the ordinary annual services of the Government for the year from 1st July, 1983, to 30th June, 1984, and may be issued and applied for or towards the several uses and purposes hereinafter expressed: —

PART IV.
GENERAL.
Variation of authorised expenditure from Consolidated Fund.
44. (1) Subject to section 34 of the Audit Act, 1902, and subsection (2), expenditure shall not be incurred on any item, subdivision, division or vote shown on the Estimates of the Consolidated Fund in excess of the sum provided therefor on those Estimates.
(2) If the exigencies of the Public Service render it necessary, the Treasurer or the person appointed by him may authorise—
(a)
the transfer of a specific amount from the recurrent services appropria- tion for any item, subdivision or division, other than for an item under the division "Other Services", to the recurrent services appropriation for any other item, subdivision or division within the same vote, other than for an item under the division "Other Services"; and
(b)
the transfer of a specific amount from the capital works and services appropriation for any item to the capital works and services appropria- tion for any other item.
Variation of authorised expenditure from the Road Transport and Traffic Fund.
45. (1) Subject to subsection (2), expenditure shall not be incurred on any division shown on the Estimates of the Road Transport and Traffic Fund in excess of the sum provided therefor on those Estimates.
(2) If the exigencies of the Public Service render it necessary, the
Treasurer or the person appointed by him may authorise the transfer of a specific
amount from any division, other than for specific capital works and services, to
any other division within the vote, other than for specific capital works and
services.
Provisions affecting sections 44 and 45.
46. (1) Nothing in sections 44 and 45 shall empower the Treasurer or the person appointed by him as referred to in those sections to authorise the transfer of any sum in augmentation of or as an addition to any salary or wages the amount of which has been fixed by law.
(2) The Treasurer shall cause the Auditor-General to be informed of every authority granted pursuant to section 44 or 45.

Appropriation.
Treasurer or lawful authority shall pay by warrant or order.
47. There shall be issued and paid any such sums referred to in sections 44 and 45 for the purposes therein mentioned in such manner and in such propor- tions as the Governor by any warrant or order in writing under his hand and directed to the Treasurer or other lawful authority may from time to time order and direct, and the payments so to be made shall be charged upon and payable out of the funds so referred to respectively; but the Treasurer shall not be held liable for any claims which may arise in connection with any of the State Depart- ments transferred to the Commonwealth on or after the date of that transfer.
Treasurer or lawful authority shall be allowed credit for moneys paid by them.
48. The Treasurer or other lawful authority shall in his or its respective accounts from time to time be allowed credit for any sum or sums of money paid by him or it in pursuance of a warrant or order in writing as referred to in section 47, and the receipts of the respective persons to whom the sum or sums is or are so paid shall be a full and valid discharge to the Treasurer or other lawful authority in passing those accounts for any such sum or sums as may be therein mentioned, and he or it shall receive credit for that sum or those sums accordingly.
