DIVISION 1—Appropriations for the year 1980-1981.

3. (1) Out of the Consolidated Revenue Fund there are hereby appropriated the sums set out in sections 4 to 25, inclusive, which sums may be issued and applied for or towards the several uses and purposes expressed in these sections for the services of the year from 1st July, 1980, to 30th June, 1981.

(2) Any amounts expended under section 33 of the Audit Act,

1902, or any Supply Act on or after 1st July, 1980, and before the date of

assent to this Act shall be deemed to have been expended out of such of the sums specified in sections 4 to 25 inclusive as may be determined by the Treasurer.

G E N E R A L .

36. (I) Subject to section 34 of the A u d i t Ac t , 1902, a n d subsect ion

(2), expend i tu r e shall not be incur red on any i tem, subdiv is ion , division or vote s h o w n on the Es t imates of the Conso l i da t ed Revenue F u n d in excess of the sum prov ided therefore on those Es t imates .

(2) If the exigencies of the Publ ic Service r ender it necessary,

the T r e a s u r e r or the person a p p o i n t e d by him may a u t h o r i z e the t ransfer
of a specific a m o u n t f rom any i tem, subdivis ion or division o the r t h a n
for specific publ ic w o r k s o r an i tem u n d e r the division " O t h e r Serv ices" ,
to any o t h e r i tem, subdivis ion o r divis ion, within the s a m e vote o the r
than for specific pub l ic w o r k s or an item u n d e r the division " O t h e r

Serv ices" .

37.       (I) Subject to subsect ion (2), expend i tu r e shall not be incurred

on any division s h o w n on the Es t imates of the M a r i t i m e Services Board
F u n d and the R o a d T r a n s p o r t and Traffic F u n d in excess of the sum

prov ided therefore on those Es t ima tes .

(2) If the exigencies of the Public Service r ender it necessary, the T r e a s u r e r or the person a p p o i n t e d by him may a u t h o r i z e the t ransfer of a specific a m o u n t from any divis ion, o t h e r than for specific publ ic works , t o any o t h e r division wi thin the vote o the r t h a n for specific publ ic w o r k s .

38. (1) N o t h i n g in sect ions 36 a n d 37 shall e m p o w e r t he T r e a s u r e r
o r the pe r son a p p o i n t e d by h im as referred to in t hose sect ions to a u t h o r i z e
the t ransfer of any s u m in a u g m e n t a t i o n of or as an add i t i on to any

salary or wages the a m o u n t of wh ich has been fixed by law.

(2) T h e T r e a s u r e r shall cause the A u d i t o r - G e n e r a l to be in formed
of every au tho r i t y g r a n t e d p u r s u a n t t o sect ions 36 a n d 37.

39.       T h e r e shall be issued a n d pa id any such s u m s referred t o in

sect ions 36 a n d 37 for the p u r p o s e s therein m e n t i o n e d in such m a n n e r
a n d in such p r o p o r t i o n s as the G o v e r n o r by any w a r r a n t or o r d e r in
wr i t ing u n d e r his h a n d a n d di rected to t he T r e a s u r e r o r o t h e r lawful

a u t h o r i t y m a y from t ime to t ime o r d e r a n d direct , a n d the p a y m e n t s so t o be m a d e shall be charged u p o n and payab le o u t of t he funds so referred t o respect ively; bu t the T r e a s u r e r shall n o t be held l iable for

a n y c la ims which m a y arise in connec t ion wi th any of t he S ta te D e p a r t ­
men t s t ransfer red t o the C o m m o n w e a l t h on or after t he d a t e of t h a t
t ransfer .
40. T h e T r e a s u r e r or o t h e r lawful a u t h o r i t y shall in his or its respect ive
a c c o u n t s f rom t ime to t ime be a l lowed credi t for any s u m o r s u m s of

m o n e y paid by h im or it in p u r s u a n c e of a w a r r a n t o r o rde r in wr i t ing as referred to in sect ion 39, a n d the receipts of t he respect ive pe r sons t o w h o m the s u m or sums is or a re so paid shall be a full a n d valid d i scharge to t he T r e a s u r e r o r o t h e r lawful a u t h o r i t y in pass ing t hose a c c o u n t s for any such s u m or sums as may be there in m e n t i o n e d , a n d he or it shall receive credi t for t h a t sum or those sums accord ing ly .
