APPROPRIATION ACT.

Act No. 34, 1943.

An Act to appropriate and apply out of the Con- solidated Revenue Fund of New South Wales certain Sums to make good the Supplies granted for the Service of the year from the 1st day of July, 1943, to the 30th day of June, 1944 (inclusive of both dates); to adjust the vote "Advance to Treasurer/ ' 1942-43, Consolidated Revenue Fund, for supplementary charges during the period from the 1st day of July, 1942, to the 30th day of June, 1943 (inclusive of both dates);

8 . Subject to section thirty-four of the Audit Act and the following proviso, expenditure shall no t be in­ curred on any i tem, subdivision, division, or vote, shown on the Est imates of the Consolidated Revenue F u n d in excess of the sum provided therefor by Par l iament on such estimates—provided t h a t if the exigencies of t he Public Service render it necessary, the Colonial Treasurer or person appointed by him may authorise the transfer of a specific amoun t from any item, subdivision, or division, other t han for specific public works or an i tem under t he division " Other Services," to any other i tem, subdivision, or division, within the same vote other t h a n for specific public works or an i tem under t he division " Other Services " ; and subject to the following proviso, expenditure shall not be incurred on any division shown on the Est imates of the Government

Nothing in these provisos shall empower the Colonial Treasurer or the person appointed by him as aforesaid to authorise the transfer of any sum in augmentat ion of or as an addition to any salary or wages the amount of which has been fixed by law.

The Colonial Treasurer shall cause the Auditor-General to be informed of every such author i ty granted as afore­ said.

9 . There shall be issued and paid the said several sums for the purposes hereinbefore mentioned in such manner and in such proportions as the Governor by any warrant or order in writing under his hand and directed to the Colonial Treasurer or other lawful author i ty may from t ime to t ime order and direct, and the payments so to be made shall be charged upon and payable out of the said funds respectively; b u t t he said Colonial Treasurer shall not be held liable for any claims which may arise in connection with any of the Sta te Depar tments t rans­ ferred to the Commonwealth on or after the date of such transfer.

1 0 . The said Colonial Treasurer or other lawful Author i ty shall in their respective accounts from t ime to t ime be allowed credit for any sum or sums of money paid by him or them in pursuance of such warrant or order in writing as aforesaid, and the receipts of the respective persons to whom the same arc so paid shall be a full and valid discharge to the said Colonial Treasurer or other lawful Author i ty in passing the said accounts for any such sums as may be therein mentioned, and he or they shall receive credit for the same accordingly.
