APPROPRIATION ACT.
Act No. 21, 1939.
An Act to appropriate and apply out of the Con solidated Revenue Fund of New South Wales certain Sums to make good the Supplies granted for the Service of the year from the 1st day of July, 1939, to the 30th day of June, 1940 (inclusive of both dates); to adjust the vote " Advance to Treasurer," 1938-39, Consolidated Revenue Fund, for supplementary charges during the period from the 1st day of July, 1938, to the 30th day of June, 1939 (inclusive of both dates); to cover payments " Unauthorised in Sus pense," Consolidated Revenue Fund, for urgent claims on account of Services of the year 1938-39; to appropriate and apply out of the Unemployment Relief Fund for the Service of the year from the first day of July, one thousand nine hundred and thirty- nine, to the thirtieth day of June, one thousand nine hundred and forty (inclusive of both dates); to appropriate and apply out of the Social Services Fund for the Service of the year from the first day of July, one thousand nine hundred and thirty- nine, to the thirtieth day of June, one thousand nine hundred and forty (inclusive of both dates); to appropriate and apply out of the Government Railways Fund for the Service of the year from the first day of July, one thousand nine hundred and thirty-nine, to the thirtieth day of June,

Assembly of New South Wales in Parliament assembled, WHEREAS we Your Majesty's most dutiful and loyal subjects, the members of the Legislative have granted to Your Majesty the several sums herein after mentioned for the Service of the year from the first day of July, one thousand nine thousand and thirty-nine, to the thirtieth day of June, one thousand nine hundred and forty (inclusive of both dates), for Services to be provided for out of Consolidated Revenue Fund; in

1 0 . Subject to section thirty-four of the Audit Act and the following proviso, expenditure shall not be in curred on any item, subdivision, division, or vote, shown on the Estimates of the Consolidated Revenue Fund, the Unemployment Relief Fund, and the Social Services Fund in excess of the sum provided therefor by Parliament on such estimates—provided that if the exigencies of the Public Service render it necessary, the Colonial Treasurer or person appointed by him may authorise the transfer of a specific amount from any item, subdivision, or division, other than for specific public works or an item under the division " Other Services," to any other item, subdivision, or division, within the same vote other than for specific public works or an item under the division " Other Services " ; and subject to the following proviso, expenditure shall not be incurred on any division shown on the Estimates of the Government Railways Fund, the Road Transport and Traffic Fund, the Metropolitan Transport Trust General Fund, the Newcastle and District Transport Trust General Fund, and the Sydney Harbour Trust Fund, in excess of the sum provided therefor by Parliament on such Estimates —provided that if the exigencies of the Public Service render it necessary, the Colonial Treasurer or the person appointed by him may authorise the transfer of a specific amount from any division, other than for specific public works, to any other division within the vote other than for specific public works.
Nothing in these provisos shall empower the Colonial Treasurer or the person appointed by him as aforesaid to authorise the transfer of any sum in augmentation of or as an addition to any salary or wages the amount
| of which has been fixed by law. |
The Colonial Treasurer shall cause the Auditor-General to be informed of every such authority granted as afore said.
1 1 . There shall be issued and paid the said several sums for the purposes hereinbefore mentioned in such manner and in such proportions as the Governor by any warrant, or order in writing under his hand and directed to the ' Colonial Treasurer or other lawful authority may from time to time order and direct, and the payments so to be
made
made shall be charged upon and payable out of the said funds respectively; but the said Colonial Treasurer shall not be held liable for any claims which may arise in connection with any of the State Departments trans- ferred to the Commonwealth on or after the date of such transfer.
1 2 . The said Colonial Treasurer or other lawful Authority shall in their respective accounts from time to time be allowed credit for any sum or sums of money paid by him or them in pursuance of such warrant or order in writing as aforesaid, and the receipts of the respective persons to whom the same are so paid shall be a full and valid discharge to the said Colonial Treasurer or other lawful Authority in passing the said accounts for any such sums as may be therein mentioned, and he or they shall receive credit for the same accordingly.
1 3 . This Act may be cited as the "Appropriation Act, 1939."
