8 . Subject t o section thir ty-four of t he Audi t Act a n d the following proviso, expenditure shall not be in­ curred on any i tem, subdivision, division, or vote, shown on the Es t imates of the Consolidated Revenue Fund , in excess of the sum provided therefor by Par l iament on such estimates—provided t h a t if t he exigencies of t he Public Service render it necessary, the Colonial Treasurer or person appointed by h im may authorise the transfer of a specific amount from any i tem, subdivision, or division, other t han for specific public works or an i tem under t he division " Other Services," to any other i tem, subdivision, or division, within t he same vote other t h a n for specific public works or an i tem under the division " Other Services " ; and subject t o the following proviso, expenditure shall not be incurred on any division shown on the Est imates of the Government Railways Fund , the Road Transport and Traffic Fund , the Metropolitan Transport Trust General Fund , the Newcastle and Distr ict Transport Trust General Fund , and the Sydney Harbour Trust Fund , in excess of t he sum provided therefor by Par l iament on such Est imates —provided t h a t if the exigencies of the Public Service render it necessary, the Colonial Treasurer or the person appointed by him may authorise t he transfer of a specific amount from any division, other t h a n for specific public works, t o any other division within t he vote other t h a n for specific public works.

Nothing in these provisos shall empower t he Colonial Treasurer or t he person appointed by him as aforesaid to authorise the transfer of any sum in augmenta t ion of or as an addit ion to any salary or wages the amount

of which has been fixed by law.

The Colonial Treasurer shall cause t he Auditor-General t o be informed of every such author i ty granted as afore­ said.

9 . There shall be issued and paid t he said several sums for t h e purposes hereinbefore mentioned in such manner and in such proportions as t he Governor by any warrant or order in writing under his h a n d and directed to the Colonial Treasurer or other lawful au thor i ty m a y from t ime t o t ime order and direct, and the payments so to be

made

made shall be charged upon and payable out of the said funds respectively; but the said Colonial Treasurer shall not be held liable for any claims which may arise in connection with any of the State Departments trans- ferred to the Commonwealth on or after the date of such transfer.

10 . The said Colonial Treasurer or other lawful Authority shall in their respective accounts from time to time be allowed credit for any sum or sums of money paid by him or them in pursuance of such warrant or order in writing as aforesaid, and the receipts of the respective persons to whom the same are so paid shall be a full and valid discharge to the said Colonial Treasurer or other lawful Authority in passing the said accounts for any such sums as may be therein mentioned, and he or they shall receive credit for the same accordingly.

11. This Act may be cited as the "Appropriation Act, 1937."
