APPROPRIATION ACT.

Act No. 54, 1936.

An Act to appropriate and apply out of the Con­ solidated Revenue Fund of New South Wales certain Sums to make good the Supplies granted for the Service of the year from the 1st day of July, 1936, to the 30th day of June, 1937 (inclusive of both dates); to adjust the vote " Advance to Treasurer," 1935-36, Con­ solidated Revenue Fund, for supplementary charges during the period from the 1st day of July, 1935, to the 30th day of June, 1936 (inclusive of both dates); to cover payments " Unauthorised in Suspense," Consolidated Revenue Fund, for urgent claims on account of Services of the year 1935-36; to provide for Services out of the Closer Settlement Fund; to appropriate and apply out of the Government Railways Fund for the Service of the year from the first day of July, one thousand nine hundred and thirty-six, to the thirtieth day of June, one thousand nine hundred and thirty-seven (inclusive of both dates); to cover payments " Unauthorised in Suspense," Government Railways Fund, for urgent claims on account of Services of the year 1935-36; to appropriate and apply out of the Road Transport and Traffic Fund for the Service of the year from the first day of July, one thousand nine hundred and thirty-six, to the thirtieth day of June, one thousand nine hundred and thirty-seven (inclusive of both dates); to cover payments

WHEREAS we Your Majesty's most dutiful and

loyal subjects, the members of the Legislative

Assembly of New South Wales in Parliament assembled,

have

have granted to Your Majesty the several sums herein after mentioned for the Service of the year from the first day of July, one thousand nine hundred and thirty-six, to the thirtieth day of June, one thousand nine hundred and thirty-seven (inclusive of both dates), for Services to be provided for out of Consolidated Revenue Fund; in adjustment of the vote " Advance to Treasurer,"

1935-36, Consolidated Revenue Fund, for supplementary

8 . Subject t o section thir ty-four of the Audi t Act and the following proviso, expenditure shall no t be in­ curred on any i tem, subdivision, division, or vote, shown on the Es t imates of t he Consolidated Revenue Fund , in excess of the sum provided therefor by Par l iament on such estimates—provided t h a t if t he exigencies of the Public Service render it necessary, the Colonial Treasurer or person appointed by h im may authorise the transfer of a specific amount from any i tem, subdivision, or division, other than for specific public works or an i tem under t he division " Other Services," to any other i tem, subdivision, or division, within the same vote other t h a n for specific public works or an i tem under t he division " Other Services" ; and subject t o the following proviso, expenditure shall not be incurred on any division shown on the Es t imates of the Government Railways Fund , the Road Transpor t and Traffic Fund , t he Metropolitan Transpor t Trust General Fund , t he Newcastle and District Transpor t Trust General Fund , and the Sydney Harbour Trust Fund , in excess of the sum provided therefor by Par l iament on such Es t imates —provided t h a t if t he exigencies of the Public Service render it necessary, t he Colonial Treasurer or the person appointed by him may authorise the transfer of a specific amoun t from any division, other t h a n for specific public works, to any other division within the vote other t h a n for specific public works.

Nothing in these provisos shall empower the Colonial Treasurer or the person appointed by h im as aforesaid to authorise the transfer of any sum in augmenta t ion of or as an addit ion to any salary or wages the amoun t

of which has been fixed by law.

The Colonial Treasurer shall cause the Auditor-General t o be informed of every such author i ty granted as afore­ said.

9 . There shall be issued and paid the said several sums for the purposes hereinbefore mentioned in such manne r and in such proportions as the Governor by any war ran t or order in writing under his hand and directed to t he Colonial Treasurer or other lawful author i ty may from t ime to t ime order and direct, and the payments so to be made shall be charged upon and payable out of t he said funds respectively; bu t the said Colonial Treasurer

shall

shall not be held liable for any claims which, may arise in connection with any of the State Departments trans- ferred to the Commonwealth on or after the date of such transfer.

10 . The said Colonial Treasurer or other lawful' Authority shall in their respective accounts from time to time be allowed credit for any sum or sums of money >
paid by him or them in pursuance of such warrant or| order in writing as aforesaid, and the receipts of the:

respective persons to whom the same are so paid shall' be a full and valid discharge to the said Colonial Treasurer or other lawful Authority in passing the said accounts for any such sums as may be therein mentioned, and he or they shall receive credit for the same accordingly.

11. This Act may be cited as the "Appropriation!
