An Act for appropriating a further sum of Fifty thousand pounds as a temporary Loan to enable His Majesty's Commissariat Depart­ ment to carry on the Military and Convict Services of New South Wales. [14th August, 1835.]

" effectual Government thereof and for other purposes relating

"thereto" it was amongs t other th ings enacted T h a t all and every t h e powers and author i t ies vested by cer ta in other Ac ts of Pa r l i amen t the re in referred to or e i ther of t h e m in t h e Governor of New Sou th W a l e s or t h e person adminis te r ing t h e Gove rnmen t thereof should thenceforward be vested in and exercised by t h e said Governor ac t ing wi th t h e advice and consent of t he Legislat ive Counci l of t h e said Colony and t h a t t he produce of t h e several duties imposed and made payable unde r and by v i r tue of t h e said Acts there in referred to and also unde r and by v i r tue of t h a t Ac t should be applied in such m a n n e r and to such purposes as t he said Governor and Council should from t ime to t ime by any L a w or Ordinance appoint A n d whereas t he demand for Bills on H i s Majesty 's Treasury from t h e proceeds of which funds have h i the r to been pr incipal ly obta ined for car ry ing on t h e Mi l i t a ry and Convict Services of th i s Colony has m u c h declined and i t is therefore expedient by a t emporary appropr ia t ion by way of loan from t h e produce of t h e said dut ies to enable H i s Majesty 's Commis­

sar iat D e p a r t m e n t to meet t h e necessary p a y m e n t s for t h e said services

un t i l fu r ther a r r angemen t s shal l be m a d e for ob ta in ing t h e requis i te supplies Be it therefore enacted by H i s Excel lency the Governor of New South W a l e s wi th t h e advice and consent of t he Legislat ive Council thereof T h a t out of t he produce of t h e said dut ies the re shal l and may be issued and applied any s u m or sums of money not exceeding fifty t h o u s a n d pounds upon Bills to be d rawn by t h e D e p u t y Com­ missary Genera l on t h e Lords Commissioners of H i s Majesty 's Treasury in favour of t h e said Governor as a fur ther t e m p o r a r y loan to enable H i s Majesty 's Commissar ia t D e p a r t m e n t to carry on t h e Mi l i t a ry and Convict Services of t he said Colony and the said Bil ls shall be depo­ sited in t h e Colonial Treasury the re to r emain u n t i l redeemed by a remi t tance of specie from E n g l a n d by H i s Majesty 's Government or un t i l negot iated in such m a n n e r as to t h e said Governor shall appear most expedient for t he publ ic in teres ts and any sum or sums which may be received as the proceeds of t h e said Bil ls shall be immedia te ly paid in to t h e hands of t he Colonial Treasurer to be appropr ia ted and applied as in t h e said reci ted Ac t is ment ioned .

A n d be it fur ther enacted Tha t t h e Treasurer of t he said Colony shal l issue and pay the said s u m or sums to such persons for t he purposes hereinbefore-mentioned u p o n such days and in such pro­ por t ions as t h e Governor for t h e t ime-being by any w a r r a n t or order in wr i t i ng to be signed by h im shall from t ime to t i m e order and direct and t h a t t h e paymen t s so to be m a d e shall be charged upon and

A n d be it fur ther enacted Tha t t he said Treasurer shall in his accounts from t ime to t ime be allowed credit for any sum or sums of money paid by h i m in pur suance of such w a r r a n t or order in wr i t ing as aforesaid and tha t t h e receipt or receipts of t he respective persons to w h o m t h e same shall be so paid shall be a full and valid discharge to t he said Treasurer in pass ing his said accounts for any such s u m or. sums as shal l be the re in men t ioned and t h a t he shal l and do receive credit for t he same accordingly.
