An Act for applying certain Sums arising from the

Revenue receivable in New South Wales to

the Service of the said Colony for the Year

One thousand eight hundred and thirty-two

and for further appropriating the said Revenue.

[21st March, 1832.]

intituled " An Act to provide for the Administration of Justice in New W HEREAS by a certain Act of Parliament passed in the ninth year of the reign of His late Majesty King George the Fourth
" South and Van Diemen's .Land and for the more effectual Govern-

" ment thereof and for other purposes relating thereto" it was amongst other things enacted That all and every the powers and authorities vested by certain other Acts of Parliament therein referred to or cither of them in the Governor of New South Wales or the person administering the Government thereof should thence­ forward be vested in and exercised by the said Governor acting with the advice and consent of the Legislative Council of the said Colony and that the produce of the several duties imposed and made payable under or by virtue of the said Acts therein referred to and also under and by virtue of that Act should be applied in such manner and to such purposes as the said Governor and Council should from time to time by any law or ordinance appoint Be it therefore enacted by His Excellency the Governor of New South Wales with the advice of the Legislative Council thereof That out of the produce of the said duties there shall and may be issued and applied any sum or sums of money not exceeding fifty-two thousand seven hundred and ninety-nine pounds ten shillings and sixpence for defraying the

charge

charge of the Civil Establishment of New South Wales for the year
one thousand eight hundred and thirty-two as hereinafter more

particularly expressed that is to say any sum or sums of money not exceeding eight hundred and twenty-eight pounds ten shillings and sixpence to defray the salaries of the Officers and the contingent expenses of the Establishment of His Excellency the Governor and any sum or sums of money not exceeding eight hundred and twenty- seven pounds and seven shillings to defray the salaries of the Officers and the contingent expenses of the Department of the Executive and Legislative Councils and any sum or sums of money not exceeding

five thousand two hundred and ninety-five pounds seventeen shillings

and sixpence to defray the salaries of the Officers and the contingent expenses of the Department of the Colonial Secretary and any sum or sums of money not exceeding twenty-five thousand five hundred and thirty-seven pounds and eighteen shillings to defray the salaries of the Officers and the contingent expenses of the Department of the Surveyor General including the Survey and Road Branches and also the sum of five thousand pounds towards the expense of rations and clothing to the convicts employed
on the roads and any sum or sums of money not exceeding three

hundred and forty-two pounds and four shillings to defray the salaries of the Officers and the contingent expenses of the Board for the Assign­ ment of Servants and any sum or sums of money not exceeding one thousand two hundred and ninety-six pounds and twelve shillings to defray the salaries of the Officers and the contingent expenses of the Department of the Colonial Treasurer and any sum or sums of money not exceeding one thousand five hundred and forty-three pounds and

two shillings to defray the salaries of the Officers and the contingent

expenses of the Department of the Auditor General and any sum or sums of money not exceeding six thousand and eighty-seven pounds four shillings and sixpence to defray the salaries of the Officers and the contingent expenses of the Department of the Customs and any sum or sums of money not exceeding one thousand and fifty-six pounds and twelve shillings to defray the salaries of the Officers and the contingent expenses of the Department of the Collector of Internal Revenue and any sum or sums of money not exceeding one thousand
three hundred and eighty-one pounds to defray the salaries of the

Officers and the contingent expenses of the Department of the Post
Office and any sum or sums of money not exceeding six hundred and

forty-five pounds to defray the salaries of the Officers and the contingent

or sums of money not exceeding two hundred and nine pounds and two expenses of the Department of the Surveyor of Distilleries and any sum shillings to defray the salaries and allowances to the Inspectors of

Slaughter-houses and any sum or sums of money not exceeding three thousand nine hundred and seventy-six pounds thirteen shillings and six­ pence to defray the salaries of the Officers and the contingent expenses

of the Department of Public Works and any sum or sums of money not

exceeding one thousand nine hundred and thirty-nine pounds and eight shillings to defray the salaries of the Officers and Men and the contingent expenses of the Department of the Mineral Surveyor and any sum or sums of money not exceeding nine hundred and eight pounds thirteen shillings and sixpence to defray th esalaries of the Officers and Men and the contingent expenses of the Department of the Master Attendant and any sum or sums of money not exceeding seven hundred and twenty-four pounds and six shillings to defray the salaries of the Officers and Men and the contingent expenses of the Department of the Colonial Botanist and any sum or sums of money not exceeding two hundred pounds to defray the salary of the Zoolo­ gist and the contingent expenses of the Colonial Museum.

2. And be it further enacted That out of the produce of the said duties there shall and may be issued and applied any sum or sums of money not exceeding eleven thousand three hundred and sixty-two pounds and nine shillings to defray the charge of the Judicial Estab­ lishment of the said Colony for the year one thousand eight hundred and thirty-two as hereinafter more particularly expressed that is to say any sum or sums of money not exceeding live thousand seven hundred and sixty-live pounds two shillings and sixpence to defray the salaries of the Law Officers and the contingent expenses of the establishment of the Supreme Court and any sum or sums of money not exceeding two thousand two hundred and twenty-seven pounds to defray the salaries and allowances to the Officers and the contingent expenses of the Court of Requests and any sum or sums of money not exceeding six hundred and ninety pounds to defray the salaries and allowances to the Officers and the contingent expenses of the Courts of Quarter Sessions and any sum or sums of money not exceeding two thousand and twenty pounds six shillings and sixpence to defray the salaries and allowances to the Officers and the contingent expenses of the Department of the Sheriff and any sum or sums of money not exceeding six hundred and sixty pounds to defray the salaries of the Coroners and the contingent expenses of Inquests.

3. And be it further enacted That out of the produce of the

said duties there shall and may be issued and applied any sum or sums

of money not exceeding eighteen thousand eight hundred and twenty
pounds and eighteen shillings to defray the charge of the Clergy and
School Establishment of the Colony for the year one thousand
eight hundred and thirty-two as hereinafter more particularly ex­ pressed that is to say any sum or sums of money not exceeding ten thousand eight hundred and eighteen pounds and three shillings to defray the salaries allowances and contingent expenses of the Episcopalian Clergy and Catechists and any sum or sums of money not exceeding five thousand nine hundred and thirty-five pounds to defray the salaries and allowances of the Masters and Mistresses and the contingent expenses of Schools and any sum or sums of money not exceeding two hundred and eighty-six pounds to defray the expense of the Establishment for the civilization of the Aboriginal Inhabitants of
New South Wales and any sum or sums of money not exceeding
eight hundred and thirty-one pounds and fifteen shillings to defray the expense of the management of the Corporation of Trustees of the Clergy and School Lands and any sum or sums of money not exceeding

Established Church of Scotland and any sum or sums of money not six hundred pounds to defray the salaries of the Ministers of the

exceeding three hundred and fifty pounds to defray the salary of the Roman Catholic Chaplain and the expense of the Roman Catholic

Schools.
4. And be it further enacted That out of the produce of the
said duties there shall and may be issued and applied any sum or sums
of money not exceeding one thousand two hundred and sixty-five

pounds eight shillings and seven-pence to defray the charge of the Military Establishment of the said Colony for the year one thousand eight hundred and thirty-two.

5. And be it further enacted That out of the produce of the said duties there shall and may be issued and applied any sum or sums of money not exceeding four hundred pounds towards defraying the salary

of the Colonial Agent for the year one thousand eight hundred and
thirty-two.
6. And be it further enacted That out of the produce of the
said duties there shall and may be issued and applied any sum or sums

of

of money not exceeding one thousand four hundred and sixty-six

pounds fifteen shillings and sixpence to defray the Pensions to retired

officers and widows chargeable upon the funds of the Colony for the

year one thousand eight hundred and thirty-two.

7. And be it further enacted That out of the produce of the

said duties there shall and may be issued and applied any sum or sums

of money not exceeding twenty-five thousand eight hundred and thirty-
seven pounds and nine shillings to defray the charge of Miscellaneous Services of the said Colony for the year one thousand eight hundred and thirty-two as hereinafter more particularly expressed that is to say any sum or sums of money not exceeding seven hundred and fifty pounds to be paid to the Colonial Secretary in fulfilment of an agree­ ment entered into with that Officer by the Right Honorable the Secre­

tary of State for the Colonies and any sum or sums of money not

exceeding one thousand and thirty-two pounds and fifteen shillings to defray the charge of allowances for travelling expenses and attendance; to Officers serving as Jurors on trials before the Supreme Court and Courts of Quarter Sessions and any sum or sums of money not exceeding two thousand three hundred and eighty-five pounds and ten shillings to defray the charge of allowances to Witnesses for travelling expenses and attendance on trials before the Supreme Court and any sum or sums

of money not exceeding seventy-five pounds to defray the charge of
allowances to Witnesses for travelling expenses and attendance on trials before the Courts of Quarter Sessions and any sum or sums of money not exceeding one hundred pounds to defray the charge of allowances to Jurors for travelling expenses and attendance on trials before the Supreme Court and any sum or sums of money not exceeding three thousand and five hundred pounds to defray the charge of construct­ ing a new Market and Market-house in the Town of Sydney and any sum or sums of money not exceeding one hundred pounds to defray the charge for new Gates and completing the enclosure to the Court of the Council Chambers in the said Town and any sum or sums of money not exceeding two hundred pounds to defray the charge of casual repairs to Government-house and Stables in the said

Town and any sum or sums of money not exceeding one thousand
pounds to defray the charge for casual repairs to the several Courts of Justice and other public buildings in the said Colony and any sum or sums of money not exceeding five hundred pounds to defray the charge for furniture for the Reception Rooms of Government- house in the said Town of Sydney and any sum or sums of money

not exceeding one hundred and fifty pounds to defray the charge for furniture for the several Public Offices in the said Colony and

any sum or sums of money not exceeding four hundred and sixty-six pounds and thirteen shillings to defray the expense for lighting and providing the necessary oil and wick for one hundred and two public lamps in the Streets of the said Town of Sydney and any sum or sums

of money not exceeding one thousand and two hundred pounds to

defray the charge for stationery for the several Public Departments in the said Colony and any sum or sums of money not exceeding seven hundred pounds to defray the charge for printing for the said Departments and including Gazettes and Almanacks and any sum or sums of money not exceeding seventy-seven pounds and eleven shillings to defray the charge for fuel and light for the said several Public Departments and any sum or sums of money not exceeding

five hundred pounds to defray the amount of drawback of duties paid on goods wares or merchandise imported into the said Colony upon

the exportation of the said goods wares or merchandise and any sum or sums of money not exceeding six thousand and four hundred pounds to defray the expense of bringing out to the said Colony female farm

servants

servants from the agricultural counties of England and any sum or
sums of money not exceeding three thousand and six hundred pounds to defray the expense of bringing out to the said Colony mechanics and laborers from England and any sum or sums of money not exceeding six hundred pounds in aid of a similar sum subscribed by the inhabitants to enlarge St. James's Church in the said Town of Sydney and any sum or sums of money not exceeding two thousand pounds to meet the payments which may be required to complete the loan of three thousand and five hundred pounds recommended to be made for the erection of the Australian College upon the terms set forth in the despatch addressed to His Excellency the Governor by the Right Honorable the Secretary of State for the Colonies bearing date the twelfth day of January one thousand eight hundred and thirty-one and any sum or sums of money not exceeding five hundred pounds subject to the directions of His Excellency the Governor towards the completion of the roof and flooring of the Roman Catholic Chapel in the said Town of Sydney.
8. And be it further enacted That out of the produce of the

said duties there shall and may be issued and applied any sum or sums

of money not exceeding two thousand pounds to the Governor for the
time-being of the said Colony to be applied to meet unforeseen
expenses on occasions of emergency.

9. And be it further enacted That the Treasurer of this Colony shall issue and pay the said several sums to such persons for the purposes hereinbefore mentioned upon such days and in such pro­ portions as the Governor for the time-being by any warrant or order in writing to be signed by him shall from time to time order and direct and that the payments so to be made shall be charged upon and payable out of the Revenues of the said Colony.

10. And be it further enacted That the said Treasurer shall in his accounts from time to time be allowed credit for any sum or sums of money paid by him in pursuance of such warrant or order in writing as aforesaid and that the receipt or receipts of the respective persons to whom the same shall be so paid shall be a full and valid discharge to the said Treasurer in passing his said accounts for any such sum or sums of money as shall be therein mentioned and that he shall and do receive credit for the same accordingly.
