The Parliament of Victoria enacts as follows:

1. Purpose

The purpose of this Act is to appropriate certain sums out of the Consolidated Fund for the financial year 1997/98.

2. Commencement

This Act comes into operation on the day on which it receives the Royal Assent.

3. Application of moneys

(1) The Treasurer may issue out of the Consolidated
Fund in respect of the financial year 1997/98 the

sum of one thousand four hundred and seventy six
million seven hundred and fifty thousand dollars
as set out in Schedule 1 for capital purposes and
the sum of eleven thousand nine hundred and two
million four hundred and thirty six thousand
dollars for current purposes as set out in

Schedule 1.

(2) If—

(a)	during the financial year 1997/98 the amount payable in respect of salaries is increased as the result of any act or determination; and
(b)	the relevant amounts specified in Schedule 1 under the heading "Current Purposes" are insufficient to provide for the payment of the increased amount payable in respect of salaries—

the Treasurer may issue out of the Consolidated Fund and apply such amounts not exceeding in total the increased amount payable in respect of salaries and any such amounts shall be and be

deemed to be appropriated in and towards the
service of the financial year 1997/98 in addition to

any other appropriation made by this Act.

(3) In sub-section (2)—

"salaries" includes wages or other payments in

the nature of salary, payments by way of
overtime or penalty rates or in lieu of long
service leave or for retiring gratuities;

"determination" includes any regulation or any award order or determination of a person or body authorised to determine minimum

salaries or wages under any law of the Commonwealth or of the State, or any Certified Agreement or Australian
Workplace Agreement approved in

accordance with the Workplace Relations agreement entered into by or on the behalf of the State.

4. Total amount to be issued and applied

The total amount that may be issued and applied for or towards the service of the financial year 1997/98 pursuant to this Act shall not exceed the sum of thirteen thousand three hundred and seventy nine million and one hundred and eighty six thousand dollars and the amounts to be applied for capital purposes and current purposes, except as provided in Section 6, in Schedule 1 for that year pursuant to this Act shall not exceed the amounts specified in that Schedule.

5. Appropriation

The sums issued and applied by this Act amounting to thirteen thousand three hundred and seventy nine million and one hundred and eighty six thousand dollars are appropriated and shall be deemed to have been appropriated for capital purposes and current purposes in and towards the service of the financial year 1997/98.

6. Alteration to Departmental appropriation

(1) The relevant Minister, with the consent of the

Treasurer, may determine that part of an amount
appropriated by this Act for capital purposes or
for current purposes may be issued and applied for
the other of those purposes.

(2) In this section, "relevant Minister" has the same

meaning as in the Financial Management Act
1994.
