An Act to appropriate additional amounts out of the Consolidated Fund for the year 1996–97 for the purpose of giving effect to certain Budget variations required by the exigencies of Government. [Assented to 25 June 1997]

Section 1 Appropriation (1996–97 Budget Variations) Act 1997 No 35

The Legislature of New South Wales enacts:

1 Name of Act

This Act is the Appropriation (1996-97 Budget Variations) Act

1997.

2 Commencement

This Act is taken to have commenced on 1 July 1996, which is the date of commencement of the Appropriation Act 1996.

3 Appropriation

(1)	Out of the Consolidated Fund there are hereby appropriated the sums identified in sections 4 to 9, inclusive, for recurrent services, which sums may be issued and applied for or towards the several uses and purposes expressed in those sections for the ordinary annual services of the Government for the year 1996–97.
(2)	The sums appropriated by this Act are in addition to any other sums that may have been appropriated.
(3)	The total sum appropriated out of the Consolidated Fund in accordance with the provisions of sections 4 to 9, inclusive, is the sum of $642,500,000.
(4)	The Treasurer may amend the appropriate payments estimates for the year 1996–97 to take into account the appropriations provided for by this Act.

4 Treasurer

The sum of $221,500,000 is hereby appropriated to the Treasurer for the recurrent services of Crown transactions.

5 Minister for Health

The sum of $134,000,000 is hereby appropriated to the Minister for Health for the recurrent services of the Department of Health.

6 Minister for Transport

The sum of $205,000,000 is hereby appropriated to the Minister for Transport for the recurrent services of the Department of Transport.

7 Attorney General

The sum of $23,000,000 is hereby appropriated to the Attorney General for the recurrent services of the Attorney General’s Department.

8 Minister for Roads

The sum of $9,000,000 is hereby appropriated to the Minister for Roads for the recurrent services of the Roads and Traffic Authority.

9 Minister for Police

The sum of $50,000,000 is hereby appropriated to the Minister for Police for the recurrent services of the New South Wales Police Service.

10 Operation of Act

(1) This Act is to be construed as if it formed part of the

Appropriation Act 1996.

(2)	This Act is an Appropriation Act for the purposes of section 21A of the Public Finance and Audit Act 1983.
(3)	The issue and payment before the date of assent to this Act out of the Consolidated Fund of the whole or any part of the sum appropriated by this Act is validated. This subsection applies whether this Act is assented to during or after the year 1996–97.
