Act N o . 3 1 , 1979 .
An Act to amend the Apprentices Act, 1969, with respect to the employment of persons under the age of 21 years in certain trades. [Assented to, 27th April, 1979.]
BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—
This Act may be cited as the "Apprentices (Amendment)
Act, 1979".
The Apprentices Act, 1969, is amended—
(a) by inserting at the end of section 26 the following subsections :— (2) An award of an apprenticeship committee prescribing a trade may be made so as to operate only if a regulation referred to in subsection (3) (b) is in force.
(3) A regulation under this Act may declare that— (a)
subsection (1) does not apply in respect of any trade specified or described in the regula tion, being a trade that is prescribed by an award of an apprenticeship committee; or
(b)
upon a trade specified or described in the regulation being prescribed by an award of an apprenticeship committee, subsection (1) shall not apply in respect of that trade,
and any such regulation shall have effect according to
its tenor.
(b)
by inserting after section 63 (1) the following subsection :—
(1A) Where a regulation made under section 26 (3) is in force in respect of a trade prescribed by an award of an apprenticeship committee, subsections (1 ) (a) and (1) (b) do not apply except in relation to the payment of any price, rate or amount fixed by the award to a person to whom the award applies.
