capacity as agent

for copyrlght owners. Further, It was

submltted that only those recordlngs In respect

of which the

copyright owners were parties or represented by partles were rn the way of such owners belng regarded as "partles" or

relevant f o r the purposes of S. 1 5 2 . If and to the extent chat

"represented by" a party for the purposes of para. 1 5 2 ( 6 ) (b) .

It was contended, however, that a dlstlnctlon had to be made between the owners of the broadcasting copyright, on the one

hand, and entitled to the beneflc

persons who merely controlled that rlght or were
