REGULATIONS UNDER THE APPLE AND PEAR ORGANIZATION ACT 1938-1948.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the AppleandPearOrganizationAct 1938-1948.

Apple and Pear Organization (Staff) Regulations.

Citation.

1. These Regulations may be cited as the Apple and Pear Organization (Staff) Regulations.

Commencement.

2. These Regulations shall be deemed to have come into operation on the first day of July, 1949.

Repeal.

3. The Statutory Rules specified in the First Schedule to these Regulations are repealed.

Definition.

4. In these Regulations, unless the contrary intention appears, “officer” means a person appointed under section 12 of the AppleandPearOrganizationAct 1938-1948.

Salaries of officers.

5.— (1.) An officer who occupies an office specified in column 1 of the Second Schedule to these Regulations shall be entitled to be paid—

(a) in respect of his service between the thirtieth day of June, 1949, and the twenty-ninth day of December, 1949—the annual salary, or salary within the limits of salary, specified, in column 2 of that Schedule opposite to that office and the increments of salary within those limits specified in column 3 of that Schedule;

(b) in respect of his service between the twenty eighth day of December, 1949, and the thirtieth day of June, 1951—the annual salary, or salary within the limits of salary, specified in column 4 of that Schedule opposite to that office and the increments of salary within those limits specified in column 5 of that Schedule; and

(c) in respect of his service on and after the thirtieth day of June, 1951—the annual salary, or salary within the limits of salary, specified in column 6 of that Schedule opposite to that office and the increments of salary specified in column 7 of that Schedule.

(2.) The salary of an officer under the last preceding sub-regulation during each of the periods specified in that sub-regulation shall be subject to variation from time to time in accordance with the provisions of regulation 106a of the Commonwealth Public Service Regulations as in force during each of those periods.

(3.) An officer shall not be entitled to an increment of salary under this regulation until he has received salary without the increment for not less than twelve months.

Conditions of employment of officers.

6.— (1.) Subject to these Regulations, officers shall be employed under the same conditions with respect to leave of absence and holidays as those prescribed in relation to officers of the Commonwealth Public Service by the Commonwealth Public Service Act 1922-1948, or by that Act as amended, and under the same conditions with respect to attendance, performance of duties, hours of duty and overtime payment, and travelling and other allowances as those prescribed in relation to officers of the Commonwealth Public Service by the Commonwealth Public Service Regulations.

(2.) Where the Board certifies that the functions and duties of an officer, or officers included in a class of officers, employed by the Board are substantially similar to those of an officer, or officers included in a class of officers, in relation to whom a determination under the Arbitration (PublicService) Act 1920-1947, or under that Act as amended, specified in the certificate makes provision with respect to a matter specified in the last preceding sub-regulation, that officer, or the officers included in that class of officers, employed by the Board shall be employed under the same conditions with respect to that matter as are prescribed by the determination.

(3.) Where a condition of employment prescribed by sub-regulation (1.) of this regulation is inconsistent with a condition of employment prescribed by sub-regulation (2.) of this regulation, the latter shall prevail and the former shall, to the extent of the inconsistency, not apply to, or in relation to, officers.

(4.) For the purposes of this regulation, a reference in the Commonwealth Public Service Act 1922-1948, or in that Act as amended, the Commonwealth Public Service Regulations or a determination under the Arbitration (PublicService) Act 1920-1947, or under that Act as amended, to the Public Service Board, the Permanent Head or the Chief Officer shall be read as a reference to the Chairman of the Australian Apple and Pear Board.

Entertainment expenses.

7. The Board may make available to the Chairman for entertainment expenses incurred by officers of the Board an amount which shall not, except with the approval of the Minister, exceed Two hundred pounds in any period of twelve months, and the Chairman may reimburse an officer from the amount so made available such expenses as, in the opinion of the Chairman, the officer has incurred for entertainment.

Officers engaged in the United Kingdom.

8.—(1.) Officers appointed and employed in the United Kingdom shall be paid at the rates and employed under the conditions prescribed by the High Commissioner (Staff) Regulations.

(2.) For the purposes of this regulation, any powers, duties and functions which, under the High Commissioner (Staff) Regulations, are exercisable by the High Commissioner or the Official Secretary shall be exercisable by the Chairman.
