3 Appeal Costs Fund Amendment (No. 1) No. 387, 1993 ˙ Short title 1. This regulation may be cited as the Appeal Costs Fund Amendment Regulation (No. 1) 1993 . ˙ Amended regulation 2. The Appeal Costs Fund Regulation 1974 is amended as set out in this regulation. ˙ Commencement 3. This regulation commences on 1 November 1993. ˙ Replacement of s.1 4. Section 1— omit, insert — ˙ ‘Short title ‘1. This regulation may be cited as the Appeal Costs Fund Regulation1974 . ’. ˙ Amendment of s.2 5. Section 2— insert (as heading)— ‘Definitions’. ˙ Insertion of new s.2A 6. After section 2— insert — ˙ ‘Approval of forms ‘2A. The chief executive may approve a form for a purpose— (a) for which a prescribed form is required or authorised to be used

(2) Section 3(a)— omit ‘ $10.00 ’, insert ‘ $14.00 ’. (3) Section 3(b)— omit ‘ $7.50 ’, insert ‘ $10.50 ’. (4) Section 3(c)— omit ‘ $1.25 ’, insert ‘ $1.75 ’. (5) Section 3(c) (proviso)— omit . (6) Section 3— insert— ‘(2) Despite subsection (1)(c), no additional fee is payable if the proceeding is an action for a small debt within the meaning of the Magistrates Courts Act 1921 . ’. ˙ Omission of s.4 8. Section 4— omit . ˙ Amendment of s.5 9.(1) Section 5— insert (as heading)—

(2) Section 5(1)— omit all words from ‘ shall be in the form ’ to ‘ and shall be signed ’, insert ‘ must be in the approved form and must be signed ’. (3) Section 5(2)— omit all words from ‘ shall be in the form ’ to ‘ and shall be signed ’, insert ‘ must be in the approved form and must be signed ’. ˙ Amendment of s.6 10.(1) Section 6— insert (as heading)— ‘Claims for payment out of fund’. (2) Section 6(1)(a) and (b)— renumber as subsections (1) and (1A) respectively. (3) Section 6(2)— omit, insert— ‘(2) An application made under subsection (1) or (1A) must be in the approved form. ’. (4) Section 6(3)— omit ‘ Every application under subregulation (1) ’, insert ‘ An application under subsection (1) or (1A) ’. (5) Section 6(4)(a)(iii)— omit ‘ of the Registrar of the Privy Council, or ’. ˙ Amendment of s.7 11. Section 7— insert (as heading)— ‘Time limit for making claims on fund’.
