Citation

1. These regulations may be cited as the Apiaries Regulations, 1988.

Interpretation

2. In these regulations, unless the context otherwise requires—

"the Act" means the Apiaries Act, 1931.

Revocation

3. The regulations made under the Act (see Gazette, 20 December, 1973, p. 3429) as varied,

are revoked.

Prescribed diseases

4. The following diseases of or affecting bees are prescribed for the purposes of the Act:

American Foul Brood;

European Foul Brood;

Sac Brood;

Para Foul Brood;

Wax Moth infestation;

Acariasis;

Braula coeca;

Nosema disease;

Chalk Brood;

Varroa jacobsonii;

Kashmir virus;

Black queen cell virus;

Acute bee paralysis;

Chronic bee paralysis;

Tropilaelaps clarea.

Notifiable diseases

5. The following diseases are prescribed as notifiable diseases for the purposes of the Act:

American Foul Brood;

European Foul Brood;

Acariasis;

Chalk Brood;

Braula coeca;

Varroa jacobsonii;

Tropilaelaps clarea.

Definition of frame-hive

6. (1) For the purposes of section 3 of the Act, a frame-hive must conform to the following requirements as to its construction and the fitting of movable frames:

(a)

the hive must consist of a box with a lid that is removable so that the movement of bees in and out of the frame-hive may be easily controlled;

(b)

the box must be fitted with movable frames supported inside the box so that they stand on edge in a vertical position;

(c)

each movable frame must—

(i)

have inserted at its centre a flat sheet of impressed bees-wax covering at least one-eighth of the area of the frame;

(ii)

be separated from all inner surfaces of the box and any other movable frame placed above it by a space of at least eight millimetres;

and

(iii)

be placed inside the box so that it can be easily removed for inspection.

Registration as beekeeper

7. (1) A person applying for registration, or renewal of registration, as a beekeeper must complete a form in the form of schedule 1 and post or deliver it to the office of the chief inspector together with the fee prescribed by this regulation.

(2) The applicant must furnish with the application such information as is required in the

application form.

(3) The prescribed fee for registration or renewal of registration as a beekeeper is—

(a)

$40; plus

(b)

45 cents for each hive used by the applicant.

(4) The Minister must, on application by a beekeeper within 6 months after commencement of a period of registration, refund the amount paid by the beekeeper under subregulation (3)(b) in respect of the registration period.

Registered beekeeper to notify change of address

9. A registered beekeeper must within one month of changing address notify the chief inspector of his or her new address.

Penalty: $500.

Application for compensation

10. (1) An application for compensation must be made by completing a form in the form of schedule 2 and posting or delivering it to the Minister.

(2) The applicant must furnish with the application such information as is required in the

application form.

Maximum amount of compensation

11. The maximum amount of compensation payable to a beekeeper under section 8c of the Act is $40.00 for each hive (including any bees, combs or appliances in the hive) destroyed or sterilized and such that no more than $1 600 is payable to the beekeeper as compensation in any three year period of registration referred to in section 5(3) of the Act.

Movement of hives

12. Within seven days of moving a hive from one location to another, a registered beekeeper

must post or deliver to the chief inspector a notice in writing that sets out the following particulars:

(a)

the date the hive was moved;

(b)

the location from which the hive was moved;

(c)

the location to which the hive has been moved;

and

(d)

the number of hives moved.

Penalty: $500.

Application for registration of a brand

13. A person seeking to be allotted a brand for the purposes of section 13a of the Act must post or deliver to the office of the chief inspector an application in writing containing the following particulars:

(a)

the name and address of the applicant;

(b)

the number of hives owned by the applicant;

(c)

the place where the hives are or will be located;

and

(d)

the brand sought, indicating the combination of letters sought—

(i)

as a first preference;

and

(ii)

as a second preference.

Prescribed manner for branding hives

14. (1) For the purposes of section 13a of the Act, a hive must be branded in the following

manner:

(a)

the brand must appear on a vertical face of the hive;

(b)

subject to subregulation (2), the brand must be located as near as possible to the centre of the face of the hive;

(c)

the brand may appear on a metal plate attached to the face of the hive or be burned, stencilled, embossed, carved or etched directly on or into the face of the hive;

and

(d)

the letters included in the brand must be at least 30 millimetres in height.

(2) Where a face of a hive has previously been branded, subsequent brands must be located on the same face, the first such brand being placed in the top left hand corner of that face and each subsequent brand being placed in the next corner proceeding clockwise.

False statements in applications

15. A person who knowingly makes a false or misleading statement in—

(a)

an application for registration or renewal of registration;

or

(b)

an application for compensation,

is guilty of an offence.

Penalty:

for a first offence—$500;

for a second or subsequent offence—$5 000.
