s1 3 s6 Apiaries Amendment (No. 1) No. 123, 1996 ˙ Short title 1. This regulation may be cited as the Apiaries Amendment Regulation (No. 1) 1996 . ˙ Regulation amended 2. This regulation amends the Apiaries Regulation 1983 . ˙ Omission of s 4 (Forms) 3. Section 4— omit. ˙ Amendment of s 5 (Form of application for classification as apiary class C) 4. Section 5, ‘Form 7’— omit, insert ‘the approved form’. ˙ Amendment of s 6 (Certificate of classification of apiary class C) 5. Section 6, ‘Form 8’— omit, insert ‘the approved form’. ˙ Amendment of s 8 (Form of application for classification as apiary class D) 6. Section 8, ‘Form 9’— omit, insert ‘the approved form’.

Section 9, ‘Form 10’— omit, insert ‘the approved form’. ˙ Amendment of s 10 (Prescribed marking of hives) 8. Section 10(2)(a)(ii)(B), ‘the Department of Agriculture or other equivalent Department in’— omit, insert ‘an appropriate official of’. ˙ Replacement of s 11 (Prescribed diseases) 9. Section 11— omit, insert ˙ Information to be contained in certificates—Act, s 31(1) 11. For section 31(1) of the Act, a certificate in the approved form must state that the bees, hives, bee products or appliances are free of disease and have not been in an area where a disease mentioned in schedule 1 exists.’. ˙ Amendment of s 13 (Lodgment of duplicate copy of certificate for introduction) 10. Section 13, from ‘either’— omit, insert— ‘the approved form’. ˙ Amendment of s 14 (Duration of certificate for introduction) 11. Section 14, ‘Form 14’— omit, insert ‘the approved form’.
s 12 5 s 13 Apiaries Amendment (No. 1) No. 123, 1996 ˙ Amendment of s 15 (Restriction on introduction of queen bees and escorts) 12. Section 15, from ‘make’— omit, insert— ‘declare that honey used for manufacturing food stores for the bees was disease free and— (a) the queen bees, escorts or queen cells— (i) for 3 months immediately before introduction, were not within a 5 km radius of bees, hives, bee products or appliances infected with a disease stated in schedule 1; or (ii) when introduced, were free from the diseases stated in schedule 1; and (b) the queen bees, escorts or queen cells are from hives that did not have macroscopic symptoms, or were otherwise substantially free, of the diseases stated in schedule 2.’. ˙ Insertion of new ss 19–24 13. After section 18— insert ˙ Diseases—Act, s 5 19. The following things are diseases under the Act— (a) a disease stated in schedule 3, part 1; (b) a parasite stated in schedule 3, part 2; (c) a pest stated in schedule 3, part 3. ˙ Exclusion of parts of the State from the Act, part 3—Act, s 10 20. The following provisions of the Act, part 3, do not apply to the State—
s 13 6 s 13 Apiaries Amendment (No. 1) No. 123, 1996 (a) section 18, in relation to a class A, B or C apiary; 1 (b) section 20. 2 ˙ Diseases about which a beekeeper need not give notice—Act, s 27(2) 21. A beekeeper need not give notice of the following diseases of hives or bee products under section 27 of the Act— (a) acute bee paralysis virus; (b) chalk brood ( Ascophaera apis ); (c) chronic bee paralysis virus; (d) european foulbrood ( Streptococcus pluton ); (e) kashmir virus; (f) larger wax moth ( Galleria mellonella ); (g) lesser wax moth ( Achroia grisella ); (h) nosema ( Nosema apis ); (i) sacbrood virus; (j) slow bee paralysis virus. ˙ No restriction on introduction of refined beeswax—Act, s 31(5) 22. Section 31(1) of the Act does not apply to the introduction of refined beeswax into the State from another State if the entry consignment for the beeswax is accompanied by a certificate, in the approved form, from an appropriate official of the other State, certifying that the beeswax is free from american foulbrood ( Bacillus larvae ). ˙ Registration fee 23. The fee for an application for or renewal of registration is $10.00. 1 Section 18 (Notice to be given of the establishment or removal of an apiary) 2 Section 20 (Notice to be given of sale of apiary)
