[1] Fair Work Australia (FWA) is required by s.285 of the Fair Work Act 2009 (the Fair Work Act) to conduct and complete an annual wage review in each financial year. In the review FWA is required to review modern award minimum wages and the national minimum wage order. Any variation resulting from the review comes into operation on 1 July in the next financial year. The statutory provisions governing the review are in ss.282-299 of the Fair Work Act. There are also special transitional provisions which are in Schedule 9 to the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009.

[2] The annual wage review for the 2009/2010 financial year will be conducted by FWA in the period between March and June 2010. Any interested person is welcome to make a submission. Submissions should be in writing and must be lodged by 19 March 2010. It is preferable that submissions be filed electronically at [email protected]. All submissions will be published on the FWA website. Any submissions in reply must be filed by 30 April 2010. There will be an opportunity to file further supplementary submissions limited to matters relevant to the Budget. Any such submissions must be filed by 14 May 2010.

[3] There will also be an opportunity for consultations with the members of the FWA Minimum Wage Panel in the week commencing 17 May 2010. The consultations will be in Melbourne with the possibility of video links to other cities if required. Time will be limited and parties wishing to take part in the consultations should express their interest in doing so by 3 May 2010.

[4] Details of the research which has been undertaken or commissioned for the 2009/10 annual wage review will be available on the FWA website.
