ANNUAL REPORTS (STATUTORY BODIES) ACT 1984—

REGULATION

(Relating to publication of codes of conduct and amendments to them)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Annual Reports (Statutory Bodies) Act 1984, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1st April, 1993

Amendment

2. The Annual Reports (Statutory Bodies) Regulation 1985 is

amended:

(a)

by inserting in clause 5 (2) after the words “statutory body” where firstly occurring the words “listed in column 1 of Schedule 2 to the Public Sector Management Act 1988 or in Schedule 3 to that Act”;

(b) by inserting at the end of clause 5 (2) the following matter:

in the case of a statutory body’s annual report for any subsequent financial year, a copy of any amendment which was made to the code, or of any new code which replaced the code, during the year

EXPLANATORY NOTE

The Annual Reports (Statutory Bodies) Regulation 1985 requires a statutory body to include in its 1991–1992 annual report a copy of the code of conduct for its officers and employees.

The first purpose of this Regulation is to limit the class of statutory bodies which must satisfy the requirement to those included in Schedules 2 and 3 to the Public Sector Management Act 1988. They are the statutory bodies which are also either administrative offices within the Public Service or declared public sector authorities which employ their own staff but are subject to direction with respect to their industrial relation policies.

The second purpose of this Regulation is to deal with subsequent changes to such a code. In any subsequent annual report, such a statutory body will be required to include a copy of any changes to its code of conduct which took place during the financial year to which the report relates. If the code has been completely substituted, a copy of the new code will have to be published in the report.
