Act N o . 184, 1980 .

An Act to amend the Annual Holidays Act, 1944, to increase penalties for breaches of that Act and to extend the time for recovery of remuneration or payments under that Act; and for other purposes. [ Assented to, 17th December, 1980.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1.      This Act may be cited as the "Annual Holidays (Amend­

ment) Act, 1980".

2. The Annual Holidays Act, 1944, is referred to in this

Act as the Principal Act.

3.      The Principal Act is amended—

(a)

by omitting from section 11 the words "one hundred dollars" wherever occurring and by inserting instead the matter "$1,000";

(b)

by omitting from section 13 (1) the words "a period of eighteen months immediately preceding the date of the application." and by inserting instead the words "the

period of 6 years immediately preceding the date of the
application but not earlier than 18 months before the date of assent to the Annual Holidays (Amendment) Act, 1980.".

Notwithstanding the operation of section 3 ( a ) , a person who, on or after the date of assent to this Act. is found guilty of an offence committed against the Principal Act before that date, shall

not be liable to any greater penalty than that to which he would have been liable if he had been found guilty of the offence immed­ iately before that date.
