AN ORDINANCE

To amend the Annual Holidays Ordinances 1973.

I, T H E G O V E R N O R - G E N E R A L of the Commonwea l th of Austral ia , acting with the advice of the Federa l Executive Counci l , hereby make the following Ord inance under the Seat of Government (Administra­ tion) Act 1910 .

A N N U A L H O L I D A Y S ( A M E N D M E N T ) O R D I N A N C E 1976

1. This Ord inance may be cited as the Annual Holidays (Amend­

ment) Ordinance 1976 .*

2 . Section 1 of the Annual Holidays Ordinances 1973f is repealed

and the following section subs t i tu ted :—

" 1. This Ord inance may be cited as the Annual Holidays Ordin­

ance 1 9 7 3 . " .

3 . Section 4 of the Annual Holidays Ordinances 1973 is amended

by omi t t ing sub-section ( 3 ) and substi tuting the following sub­

s e c t i o n : —
" ( 3 ) Wi thou t prejudice to any rights a person may have under
an award or agreement , a person is not entitled unde r this Ord inance

to an annua l holiday at the end of a year of employment if, dur ing

the y e a r —

(a) the average number of hours worked by that person in a

week did no t exceed 2 4 ; o r

(b)	the person received, under an award or agreement, a
paymen t or payments that was or were in substi tut ion for an annua l hol iday for that year." .
