s1 2 s4 Animals Protection Amendment (No. 1) No. 275, 1998 ˙ Short title 1. This regulation may be cited as the Animals Protection Amendment Regulation (No. 1) 1998 . ˙ Regulation amended 2. This regulation amends the Animals Protection Regulation 1991 . ˙ Amendment of s 2 (Definitions for pt 2) 3.(1) Section 2, definition “the Code” omit . (2) Section 2— insert— “NHMRC code” means the sixth edition of the Australian code of practice for the care and use of animals for scientific purposes, published by the National Health and Medical Research Council. “scientific activity” means an activity performed to acquire, develop or demonstrate knowledge or techniques in a scientific discipline, and includes teaching, but does not include an activity that is a scientific experiment. 1 ’. (3) Section 2, definition “scientific establishment” , from ‘, that’— omit . ˙ Replacement of s 3 (Persons bound by the Code) 4. Section 3— omit, insert— 1 For the definition of “scientific experiment”, see section 3 (Interpretation) of the Act.
s5 3 s7 Animals Protection Amendment (No. 1) No. 275, 1998 Compliance with NHMRC code 3.(1) For section 7(1)(f) 2 of the Act, a scientific experiment is conducted in accordance with the regulations if it is conducted in a way that complies with the NHMRC code. 3 (2) A person or scientific establishment that conducts, or intends to conduct, a scientific experiment or uses, or intends to use, an animal for a scientific activity must comply with the NHMRC code, to the extent it is relevant to the acquisition, breeding, care, disposal, housing, study, transport and use of the animal. (3) Subsection (2) does not apply if the scientific experiment or scientific activity is one in which wild birds are trapped, banded and immediately released.’. ˙ Amendment of s 4 (Scientific experiments subject to approval of Minister) 5. Section 4, ‘Code’— omit, insert— ‘NHMRC code’. ˙ Amendment of ss 6 and 7 6. Sections 6(2) and 7(2), penalty— omit. ˙ Insertion of new pt 4 7. s7 4 s7 Animals Protection Amendment (No. 1) No. 275, 1998 PART 4—CIRCUS ANIMALS ˙ Definition for pt 4 8. In this part— “circus code” means the Queensland Code of Practice for the Welfare of Animals in Circuses published by the department. 4 ˙ Compliance with circus code 9. The owner of a circus animal must comply with the circus code to the extent it is relevant to the acquisition, breeding, care, display, housing, training and transport of the animal.’. ENDNOTES 1.
