Legislative Council and Legislative Assembly of Queens- land in Parliament assembled, and by the authority of the same, as follows ;- . I This Act may be cited as "The Commonwealth Short title. Pou'ers (Air Navigation) Act of 1921." " 2. Nothing in this Act shall empower the Parliament Saving, of the Commonwealth, or any authority constituted or to be constituted under the Commonwealth, to affect or restrict the rights and powers of the State of Queensland in regard to- (a) The acquisition or ownership by the said State of aircraft or aerodromes; or • (b) The use for the purpose of the Government of the said State of aircraft operating within the said State; or (c) Police powers; and such rights and powers shall be retained by the said State as if this Act had not been passed. 4. Interpreta. 3. In this Act, unless the context otherwise requires, tion. the following terms have the meanings respectively assigned to them, that is to say:- Animal. " Animal "-Anv wild animal whether native or imported to' vrhich the provisions of this Act apply: the term includes the eggs and young of such animal; BIrd. "Bird "-Any wild bird whether native or im- ported to which the provisions of this Act apply: the term includes the young or eggs of such bird ; Close season " Close season"-The period which is for the time being prescribed as the close season for the animal or bird concerned; District. " District"-A district constituted under this Act; Imported. "La-nd" includes land covered by water, and any Land. waters within the territorial jurisdiction of Queensland; "Minister"-The Secretary for Agriculture and Minister. Stock or other Minister of the Crown ch8,rged for the time being with the administration of this Act; "Officer"---An officer or person authorised by the Officer. Minister to act in the execution of this Act; and a ranger; and any member of the police force; " Prescribed "-Prescribed by this Act; Prescribed. "Ranger"-A ranger appointed under this Act; Ranger. "Regulations"-Regulations made under this Regulations. Act; ~ , Sanctuary"- Any part of Queensland, whether Sanctuary. Crown land or not, constituted a sanctuary under this Act; ~ ' Swivel gun"-Every gun or fowling-piece-- Swivel gun. (a) Having a barrel exceeding forty-two inches in length; or (b) Ha ving a single barrel exceeding mgb t pounds avoirdupois in weight, or having a doubIe barrel exceeding fourteen pounds avoirdupois in weight; or (c) Having a single barrel the bore 01 which exceeds eight calibre, or having a double barrel the bore of which exceeds ten calibre; or (d) Being of a weight exceeding sixteen pounds avoirdupois; or (e) Having more than two barrels; or (j) Not being such a gun or fowling-piece as is habitually raised at arm's length and fired without other support from the shoulder; and every combination of more than two guns or fowling-pieces temporarily or permanently secured together: But no firearms belonging to or used by His Majesty or the naval or military forces or the police force shall be deemed to be swivel guns:

"Take or kill "-The hunting, shooting, ki1ling~ destroying, poisoning, netting, snaring, liming~ spearing, pursuing, taking, disturbing, or injuring of any animal or bird, or the off- spring, young, or eggs thereof; " This Act "-This Act and all Orders in Council and regulations, orders, and directions made and given thereunder; "Vessel "-Any boat, punt, raft, or navigable vessel of any kind; " 'Veapon" includes a firearm of any description,. and any airgun or other kind of weapon from which any shot, bullet, or other missil-e can be discharged: where a weapon is carried in parts by two or more persons in company, each and. everyone of such persons shall be deemed to carry the weapon. Districts, 4. The Governor in Council may from time to time &c. !i2 Vic. by Order in Council- No.17, ss. 4, 5, 6 (i.) Declare any part of the State to be a district 1 Geo. V. for the purposes of this Act, and abolish any No. 17, s. 5 district; Societies. (ii.) Approve of the constitution and rules of any society duly formed for the furtherance of the objects of this Act; Animals and birds and close season. (iii.) Declare the animals and birds to which the provisions of this Act shall apply, and fix a. period of close season for the same respec- tively, whether for the whole State or for any defined part or parts thereof; Sanetuary. (iv.) Declare any Crown land, and with the consent of the owner or occupier thereof any other land" to be a sanctuary in which it shall be unlawfu! for any person to take or kill any animal or bird or any specified animals or birds; Prohibition of sale. (v.) Prohibit the selling or exposing for sale of any specified animal or bird for such period as is fixed by the Order; Limiting numbErs. (vi. ) Prescribe the maximum number of any specified animal or bird which anyone person may take or kill or have in possession on anyone day or within any specified period;

Such officers shall have such powers and duties as are conferred and imposed upon them by this Act, and such other powers and duties as the Ivlinister may from time to time dircct. It shall be the duty of every officer to do all necessa,ry acts for carrying this Act into effect and for preventing and punishing any breach thereof. For such purpose they slmll in addition to the powers conferred upon them by this Act have aB the powers and authorities of a constable. 6. (1.) The Minister may in writing authorise any Authorising person to exercise all or any of the powers conferred by officers. this Act on officers, and may at any time revoke such authority. (2.) Subject to such authority, every person so authorised shall have all the powers conferred by this Act on officers. 7. Any person who, in contravention of this Act., liS. 12, 14. takes or kills any animal or bird or uses any instrumpnt \ V~ H\ . tever, net, or other means, for the purpose of taking or killing any animal or bird in a sanctuary, shall be liable to a penalty not exceeding twenty pounds nor less than two pounds, and in addition to a penalty not exceeding ten pounds nor less than one pound for each animal or bird so taken or killed. (3.) Any person who, without authority in that behalf, the proof whereof shall lie upon him, enters upon a sanctuary in search or pursuit of or for the purpose of taking or killing any animal or bird shall be liable to a penalty not exceeding twenty pounds nor less than two pounds. (4.) Any person who puts or places, or permits to be put or placed, or assists 01' attempts to put or place, any poisonous m!lterial injurious to an:mals or birds in or upon a sanctuary shall be. liable to a penalty not exceeding fifty pounds nor less than two pounds. (5.) There shall be set up, at convenient and con- spicuous places on the boundaries of every sanctuary, notices legibly written or printed, stating that the sanctuary has been constituted, and indicating in a concise manner the extent of the sanctuary. Any person who removes, damages, or defaces any such notice shall be liable to a penalty not exceeding twenty pounds nor leES than two pounds. Taking or 9. And if such person does not give an account to the satisfaction of such police magistrate or clerk of petty sessions of such things or pOlson being in the place where they were seized, or of his possession of them, he shall be liable, except in the case of poison, to a penalty not exceeding five pounds, or in case of poison .a penalty not exceeding ten pounds. (4.) He may require any person offending againstuefusing to this Act to give his name in full and u- '- lace of abode. . and pglalvceena 0 frne, to deliver up any animals or birds, instrument, weapon, abode, &c. net, or other means of destruction or capture in his possession. . If such person, after being so required, refuses to give his full name or place of abode, or gives a false name or place of abode, or does not deliver up any animaJs or birds, instrument, weapon, net, or other means of destruction or capture to any officer who demands the same, he may be- arrested and taken before a police magistrate or clerk of petty sessions, and shall be liable to a penalty not exceeding fiv-e pounds. (5.) Any person Who obstructs, resists, or assaults, Obstruction. or incites or encourages any person to obstruct, resist, or assault, any officer or any other person in the execu- tion of his duty under this Act, shall be liable to a penalty not exceeding fifty pounds, in addition to any other penalty he may have incurred under this Act, and the adjudicating court may also order and award a sum sufficient to cover any damage which any such .officer or person has sustained by such obstruction, resist- ance, or assault, such sum to be recoverable in the same manner as the penalty.

Authorise the trustees or managers of any public gardens, grounds, or exhibition to have and keep in their possession or control any animals or birds of any kind specified in such order, or any eggs, flesh, skin, or feathers. thereof; Collection for scientific purposes. In state of domestica- tion or (;aptivity. (ii.) Authorise any person to eollect for scientific purposes any animals or birds or their eggs; (iii.) Authorise any person to retain in a state of domestication or captivity such animals or birds as are specified. (2.) The period during which any such order is to be in force shall be specified in such order. (3.) The Minister may at any time revoke any such order. Permits to 16. (1.) (2.) It shall not be lawful for any tra,pper to keep or store or have in possession any cyanide of potassium. Exceptions. 17. This Act, except the provisions thereof prohibit- ing the use of poison, shall not apply to- (a) Any person killing any native animals or birds upon his own land for the bona fide protec- tion of his own crops or orchard, or to any employee killing any native anirnals or birds upon the land of his employer by direction of such employer for the bona fide protection of such employer's crops or orchard, provided that the proof of the necessity for such killing shall in every case be on the defendant; or (b) Any aboriginal killing any native animals or birds for his own food.

No. 17, (a) Of any order to prosecute, or of the particular ss. 14, HI. or general a,ppointment of any officer; or (b) Of the authority of any officer under this Act if s llch officer purport;d to act thereunder; or (c) Of the bOUl~daries of a sanctuary. (ii.) Possession of any animal or bird 01' of any part thereof shall be prima facie evidence of the unlawful taking or killing thereof. (iii.) Having in possession,. when trespassing upon any sanctuary or other land, any implements or means for taking or killing animals or birds shall be prima facie evidence of the purpose of the entry on such land, (iv.) When it is proved that a gun was fired in or from any vessel without having been raised at arm's length and fired from the shoulder with- out other support, such proof shall, without nreiudice to any other evidence available, be ~ ufficient evidence that such gun was 8, swivel gun. (v.) 'Vhere any person is charged with buying, selling, offering or exposing for sale, consigning, or having in his possession or control any animal or bird or carcass, flesh, skin, eggs, feathers, or other portions of any ~ mimal or bird contrary to this Act, the onus of proof that such animal or bird, carcass, or flesh, skin, eggs, feathers, or other portions were lawfully bought, sold, offered or exposed for sale, consigned, or in his possession or control shall be upon the defendant. 19. Any person who fails or neglects to 0bserveany penalties. of the provisions of this Act, or does or commits any- thing contrary to the true intent and n;eaning thereof, shall, if no other penalty is provided, be liable to a penalty not exceeding twenty pounds. Regu.lations. 20. (1.) The Governor in Council may from time to s ~ o~ : ~ : 23, time make all such regulations as he deems necessary for carryin.g this Act into fun effect; and, without limiting . the generality of this power, regulations may be made for all or any of the following purposes : - I"icenscs c &c, (i.) The issue of licenses and permits; the condi- tions on which licenses and permits under this Act may be granted, suspended, or revoked, and their currency; the persons by whom the same may be granted, suspended, or revoked; Protection. (ii.) The protection, preser-vation, and propagation of animals and birds ; Sanctuaries, (iii.) Preventing interference with, injury to, or contamination, pollution, or obstruct 1 0n of any sanctuary or other land, or the animals and birds therein ; (iv.) Defining the duties of officers under this Act; Societies. (v.) Defining the duties, powers. and privileges of approved societies;

Licensing- (a) Persons to take or kill or to sell any specified Licenses. imported animals or birds in any district during any open season; (b) Dealers in skins, and agents buying on behalf of such licensed dealers; (c) Persons carrying on the business of buying and selling native animals or birds: Prohibiting unlicensed persons from so doing, dealing, acting, or carrying on business; (vii.) Issuing permits to trappers; Permits to trappers. (viii.) Prescribing records. to be kept by licensed Records. persons; (ix.) Prohibiting the use of electric or other artificial Electric torches when irapping ; torches. (x.) The inspection and licensing of the shops and Bird dealers, other premises of birn dealers and keepers; &c. regulating the cleansing and sanitary condi- tions of shops and cages; prescribing the conditions on which birds may be kept in confinement or captivity; ensuring a proper food and water supply for and generally safe- guarding birds ; (xi.) The fees to be paid for licenses and permits Fees. iS6ued under this Act; (xii.) Enforcing or elucidating the provisions of this Generally. Act, and furthering the objects thereof. The regulations may impose a penalty not exceed- ing fifty pounds for any breach of such regulations or of any Order in Council issued under this Act. (2.) All such regulations shall be published in the Gazette, and shall be laid 1::efore both Houses of Parlia- ment within fourteen days after the making thereof if Parliament is then sitting, and" if Parliament is not then sitting, then within fourteen days after the next meeting of Parliament. (3.) All regulations purporting to be made by the Governor in Council under and for the purposes of this Act, and published in the Gazette, shall be read as one with this Act and construed as being of equal validity, and shall be judicially noticed.

If both Houses of Parliament respectively pass a resolution disallowing any such regulation, of which resolution notice has been given at any time within fourteen sitting days of each House respectively after such regulation has been laid before it, such regulation shall thereupon cease to have effect, but without prejudice to the validity of anything done thereunder in the meantime.
