Animal Welfare Amendment Regulations 2004

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Animal Welfare Act 1993 .12 July 2004

1Short titleThese regulations may be cited as the Animal Welfare Amendment Regulations 2004 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Animal Welfare Regulations 1993 are referred to as the Principal Regulations. 4Regulation 3 amended (Interpretation) Regulation 3 of the Principal Regulations is amended by inserting after the definition of NRA the following definition: therapeutic purposes means for the purposes of treating a disease or medical condition; 5Regulation 4A substituted Regulation 4A of the Principal Regulations is rescinded and the following regulation is substituted: 4APrescribed acts (1) For the purpose of section 8(2)(k) of the Act, the following are prescribed acts: (a) the strangling of an animal with a device or by any other means; (b) the docking of the tail of a dog (canis familiaris). (2)  Subregulation (1)(b) does not apply to a veterinary surgeon who for therapeutic purposes, using anaesthesia, docks the tail of a dog (canis familiaris).
