Animal Welfare Act 1992

1. Name of regulation

   This regulation is the Animal Welfare Amendment Regulation 2025 (No 1).

2. Commencement

   This regulation commences on the day after its notification day.

   NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

3. Legislation amended

   This regulation amends the Animal Welfare Regulation 2001.

4. New section 5A (1A)

   insert

   (1A)However, the item mentioned in subsection (1) (a) is not prescribed in relation to the use or possession of the item by any of the following people:

   (a)an authorised person exercising a function under the Biosecurity Act 2023;

   (b)a conservation officer exercising a function under the Nature Conservation Act 2014;

   (c)a trapping permit-holder;

   (d)a person holding a nature conservation licence that authorises the person to carry out trapping.

5. Section 5A (2), new definitions

   insert

   conservation officer—see the Nature Conservation Act 2014, dictionary.

   nature conservation licence—see the Nature Conservation Act 2014, section 262.
