(Companion Animals) Regulation

Animal Research Act 1985

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Animal Research Act 1985.

Explanatory note
The objects of this Regulation are:

(a) to prevent an impounding authority from supplying any dog or cat to a licensed animal supplier for the purpose of the dog or cat being used in animal research, and
(b) to prevent any dog or cat from being supplied to a licensed animal supplier for use in connection with animal research unless, when it is supplied, it is accompanied by a declaration, made by or on behalf of its owner, to the effect that approval has been given to its use in connection with animal research, and
(c) to make consequential amendments and update a number of obsolete references.

This Regulation is made under the Animal Research Act 1985, including section 62 (the general power to make regulations) and section 4 (the power to make regulations with respect to a Code of Practice).

1      Name of Regulation

This Regulation is the Animal Research Amendment (Companion

Animals) Regulation 1999.

2 Commencement

This Regulation commences on 18 October 1999.

3 Amendment of Animal Research Regulation 1995

The Animal Research Regulation 1995 is amended as set out in

Schedule 1.

Schedule 1 Amendments

(Clause 3)

[1]      Clause 3 Definitions

Omit the definitions of impounding authority and pound from clause
3 (1).
Insert instead, in alphabetical order:

impounding authority means:

(a) an impounding authority within the meaning of the Impounding Act 1993, or
(b) a pound operator within the meaning of the Companion Animals Act 1998.

[2]      Clause 3 (1), definition of “school”

Omit “Reform”.

[3]      Clause 11 Prescribed particulars

Omit “Department of School Education” from clause 11 (1) (d).
Insert instead “Department of Education and Training”.

[4]      Clause 22 Animals may be supplied to holders of animal supply licences: sec. 48

Omit “or impounding authority”.

[5]      Schedule 1 Supplementary provisions of the Code of Practice

Omit “AND IMPOUNDING AUTHORITIES” from the heading to Part
4.

Schedule 1 Amendments

[6]      Schedule 1, clause 28 (1)

Omit the subclause. Insert instead:

(1) A person may supply to a licensed animal supplier, and a licensed animal supplier may accept from any person, any animal for use in connection with animal research, but only if the animal is accompanied by a document that complies with subclause (2).

[7]      Schedule 1, clause 28 (3)

Insert after clause 28 (2):

(3) Despite subclause (1), an impounding authority may not supply to a licensed animal supplier, and a licensed animal supplier may not accept from an impounding authority, any animal for use in connection with animal research.

(4) Subclause (3) applies not only to supply effected directly but also to supply effected indirectly by means of an agent or intermediary.

Omit the clauses.

[9]      Schedule 3 Animals exempted from licensing requirements for supply

Omit “Department of School Education” from clause 8. Insert instead “Department of Education and Training”.
