ANIMAL RESEARCH ACT 1985 - REGULATION

(Relating to fee exemptions for schools)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Animal Research Act 1985, has been pleased to make the Regulation set forth hereunder.

The Animal Research Regulation 1990 is amended by inserting after

clause 24 the following clause:

Exemption from fees
25. (1) A corporation is exempt from the operation of section 18 (2) (d) of the Act (which requires an application for accreditation as a research establishment to be accompanied by a fee) if:

(a) the corporation is a school; or

(b) the accreditation is only for the purpose of allowing animal research to be carried out in a school or schools.

(2) A school is exempt from the operation of section 37 (2) (d) of the Act (which requires an application for an animal supplier’s licence to be accompanied by a fee) if:

(a) the school requests the exemption; and

(b)

the Minister is satisfied, on the advice of the Secretary, that requiring payment of the fee would be an unreasonable imposition on the school.

EXPLANATORY NOTE

The object of this Regulation is to amend the Animal Research Regulation 1990:

(a) to exempt schools and corporations seeking accreditation for schools to carry out animal research from payment of the application fee for accreditation as an animal research establishment; and
(b) to exempt a school from payment of the application fee for an animal supplier’s licence if the school requests the exemption and the Minister is satisfied (on the advice of the Secretary) that requiring payment of the fee would be an unreasonable imposition on the school.
