    Editorial changes

    The Legislation Act 2001, part 11.3 authorises the Parliamentary Counsel to make editorial amendments and other changes of a formal nature when preparing a law for republication.  Editorial changes do not change the effect of the law, but have effect as if they had been made by an Act commencing on the republication date (see Legislation Act 2001, s 115 and s 117). The changes are made if the Parliamentary Counsel considers they are desirable to bring the law into line, or more closely into line, with current legislative drafting practice.

    This republication does not include amendments made under part 11.3 (see endnote 1).

    Uncommenced provisions and amendments

    If a provision of the republished law has not commenced or is affected by an uncommenced amendment, the symbol  U  appears immediately before the provision heading.  The text of the uncommenced provision or amendment appears only in the last endnote.

    1. Name of regulation

      This regulation is the Animal Diseases (Bees) Regulation 2000.

    2. Definitions for regulation

      In this regulation:

      NoteA definition applies except so far as the contrary intention appears (see Legislation Act, s 155).

      broodbox means the bottom box of an active beehive.

      frame hive means a beehive that—

      (a)    contains only moveable frames that can be readily and separately removed for examination; or

      (b)    contains—

      (i)   fixed frames in all honey super-boxes of the beehive; and

      (ii)   only moveable frames, that can be readily and separately removed for examination, in the broodbox of the beehive; and

      (iii)   a device fitted immediately above the broodbox of the beehive that excludes the queen bee from all honey super-boxes of the beehive.

      honey super-box means an upper box of a beehive in which honey is stored.

    3. Honey bees to be kept in frame hives

      A person must not keep honey bees other than in a frame hive.

      Maximum penalty:  10 penalty units.

    4. Honey not to be exposed

      A person must not expose honey or honeycomb, other than in a frame hive, in a way that honey bees may have access to it.

      Maximum penalty:  10 penalty units.
