ANGLICAN CHURCH OF AUSTRALIA (BODIES

CORPORATE) ACT 1938—ORDER

GORDON SAMUELS, Governor.

I, the Honourable Gordon Samuels AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 4(3) of the Anglican Church of Australia (Bodies Corporate) Act 1938, do, by this my Order, declare that the persons who for the time being are members of the Emmanuel Anglican College Council, constituted under the Emmanuel Anglican College Constitution Ordinance 1997 of the Diocese of Grafton shall be a body corporate under the name “Emmanuel Anglican College Council”.

Explanatory note

Section 4 of the Anglican Church of Australia (Bodies Corporate) Act 1938 provides that the persons who, for the time being, are the members of an unincorporated body that is constituted by an ordinance of the Synod of a diocese for the purpose of managing, governing or controlling an institution or organisation of the Anglican Church of Australia, or of dealing with any church trust property, may be the subject of another ordinance by that Synod declaring that it would be expedient to constitute them as a body corporate. Once the second ordinance is passed by the Synod, the Governor may, by order published in the Gazette, declare the members of the unincorporated body to be a body corporate.

Anglican Church of Australia (Bodies Corporate) Act 1938—Order

Explanatory note

The purpose of this Order is to provide for the members of the Emmanuel Anglican College Council to be a body corporate known as “Emmanuel Anglican College Council”. The relevant ordinances are the Emmanuel Anglican College Constitution Ordinance 1997 and the Emmanuel Anglican College Incorporation Ordinance 1997.

This Order is made under section 4 (3) of the Anglican Church of Australia

(Bodies Corporate) Act 1938.
